Biography

Bill is a partner with twenty years as a litigation attorney practicing in the areas of consumer credit litigation, ERISA litigation, class actions, and RICO.

Representative Experience

Representation of major consumer lenders in defense of numerous individual and state and national class actions involving various consumer lending practices under federal law and state law causes of action. The kinds of claims defended include those brought under federal statutes, such as the Real Estate Settlement Procedures Act, the Truth In Lending Act, the Home Ownership and Equity Protection Act, the Equal Credit Opportunity Act, the Fair Housing Act, the Fair Debt Collections Practices Act, the Fair Credit Reporting Act, and the Racketeer Influenced and Corrupt Organizations Act, as well as state law based claims for fraud, forgery, breach of contract, wrongful foreclosure, unfair and deceptive trade practices, breach of fiduciary duties, credit defamation, improper collection practices, and predatory lending practices. Actions have been defended in state and federal courts, arbitral fora, and before regulatory agencies. Extensive experience with allied issues commonly encountered by consumer lenders, including claims arising out of the sale of credit insurance products, title insurance coverage disputes, implementing and enforcing consumer arbitration programs, and privacy issues.

Participated in the representation of Healthtrust, Inc. in a major defendant's class action brought by the client in relation to an ERISA retirement plan. Summary judgment was successfully obtained for the client and the case eventually settled on favorable terms while on appeal.

Participated in the representation of The Southern Company and its affiliates in defense of class actions brought by ratepayers under RICO and other federal law and state law causes of action. All such cases concluded with judgments favorable to the client.
