Biography

Aaron Wallisch has extensive experience assisting clients with the compliance and enforcement of federal, state and local laws and regulations, including solid and hazardous waste, hazardous materials transportation, pesticide use and registration, homeland security, oil spill prevention, storm water control, storage tanks, and air pollution. He regularly represents trade groups and individual companies in advocacy at the legislative or federal agency level in the development of new laws and regulations.

Mr. Wallisch has represented companies responding to federal criminal investigations and conducted internal company audits related to compliance with environmental and transportation regulations.

Significant Matters

For over eight years, Mr. Wallisch has represented the Utility Solid Waste Activities Group (USWAG), a trade group of over 110 electric and gas utilities and associations that together represent more than 73 percent of the total electricity generating capacity in the U.S. and service more than 95 percent of the nation's consumers of electricity. For USWAG, he provides counseling and advocacy in various regulatory matters arising under the Resource Conservation and Recovery Act (RCRA), the Toxics Substance Control Act (TSCA), the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Hazardous Materials Transportation Act (HMTA), the Oil Pollution Act (OPA) and the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). He regularly engages with the Environmental Protection Agency (EPA), congressional committees, and other trade groups to provide regulatory and legislative advocacy and compliance assistance for the trade group and its individual company members. He was successful in persuading the EPA to provide tailored rules for electric utility facilities in the recent amendments to the Spill Prevention, Control and Countermeasures (SPCC) rules and successfully advocated for the re-registration of key wood treatment chemicals under FIFRA. He conducted a detailed internal audit of a large electric utility related to RCRA and HMTA compliance that resulted in changes to corporate operational practices. He also represented one of the largest international shipping companies in a matter involving HMTA preemption of state routing laws and assisted a major retailer in responding to investigations of HMTA noncompliance.

Mr. Wallisch has an active pro bono practice representing landlords and tenants before the D.C. Superior Court and assisting in the preparation of wills and powers of attorney for the elderly.
