Recent Work / Representative Matters
On behalf of a class of nursing home residents, obtained a $677 million verdict - one of the largest verdicts of the decade.
First chair of trial team that obtained a complete defense verdict for our client, a real estate developer, in a case seeking millions of dollars in damages for alleged unfair competition, breach of contract, negligence, and fraud.
After defeating plaintiff's summary judgment motion in a case regarding patent mismarking and Lanham Act claims, we settled the case for a fraction of plaintiff's previous demands.
Defended Black & Veatch in a case seeking more than $60 million in damages in connection with a liquified natural gas project in Baja California. Prevailing on several pre-trial motions led to a favorable settlement.
Successfully defended employment-related class actions for several clients, including Rent-A-Center, Fidelity National Financial, Carrows Restaurants, Coco's Restaurants, and BeavEx.
On behalf of Surge Global Energy, Inc., obtained dismissal of case seeking $300 million in damages arising from an oil and gas exploration project in Canada.
Represented GE Capital in a multi-party contract dispute regarding MRI equipment and negotiated a global settlement at mediation that resulted in a substantial payment to our client.
On behalf of Merrill Lynch, Esquire Solutions, Fidelity National Financial, and several other clients, successfully defended and prosecuted cases involving alleged misappropriation of trade secrets.
In an insurance dispute arising from a Hawaiian condominium conversion project, obtained a multi-million-dollar settlement for our client, LaeRoc Funds.
Successfully defended the firm's arbitration award on appeal, which resulted in a published opinion: Luce, Forward, Hamilton & Scripps LLP v. Koch (2008) 162 Cal.App.4th 720.
Prevailed on appeal and obtained appellate sanctions in Luce, Forward, Hamilton & Scripps LLP v. Ferreira (2009) 2009 Cal.App.Unpub. LEXIS 9342.
Successfully defeated a motion to compel arbitration and confirmed the ruling on appeal for Anchor Bay Capital.
