Adam is a member in the Litigation Section in Mintz Levin's Boston office. His practice encompasses a wide range of litigation matters, with an emphasis on securities-related issues, and includes significant federal and state court trial experience. Adam represents corporations, officers, directors, accountants, and other individuals in SEC investigations and enforcement proceedings, as well as in civil litigation. He is also a member of the firm's Subprime Practice Group. In 2001-2002, while on leave from the firm, Adam practiced as a Special Assistant District Attorney in the Middlesex County District Attorney's Office. During that time, he prosecuted and tried numerous criminal cases.
Adam's recent significant litigation accomplishments include:
· Representing a public company defendant in a four-week jury trial that successfully defeated a $30 million punitive damages claim brought in the Business Litigation Session of the Massachusetts Superior Court.
· Obtaining a defense verdict on all claims after a jury trial on behalf of several public company officers and directors in a securities fraud case in federal court in Massachusetts.
· Securing, on behalf of a public company client, a $100 million settlement in connection with a dispute concerning investments made on its behalf in certain failed auction rate securities.
In addition to his litigation experience, Adam has published numerous articles on securities-related topics, and recently co-authored the Securities Litigation chapter in the definitive Massachusetts Continuing Legal Education compilation, Business Torts of Massachusetts. He has also served as an adviser to the Harvard Law School Trial Advocacy Workshop. In 2005, 2006, 2007, 2008, and 2009, Boston and Law and Politics magazines named Adam one of the top young lawyers in Massachusetts, including him in their list of Massachusetts Super Lawyers "Rising Stars," placing him in the top 2.5% of attorneys age 40 or younger, or in practice 10 years or less in Massachusetts. Most recently, he was recognized as one of just seven "Future Stars" in business litigation throughout the state by Benchmark: Litigation 2009, and by the Greater Boston Chamber of Commerce as one of "Boston's Future Leaders" for 2009.
Adam is admitted to practice in Massachusetts, the U.S. District Court for the District of Massachusetts, and the U.S. Court of Appeals for the First Circuit. He is a member of the American, Massachusetts, and Boston Bar Associations. He received his B.A. in political science from The American University, Washington, D.C. and his M.A. in public administration from Framingham State College. He earned his J.D., magna cum laude, from New England School of Law, where he served as Executive Case and Note Editor of the New England Law Review, and authored "United States Term Limits, Inc. v. Thornton, Revisiting Justice Story in the Debate Over Term Limits and the Reserved Powers Doctrine," 31 New Eng. L. Rev. 567 (1997). Adam was also a New England Scholar, and was twice a recipient of the Trustees' Academic Scholarship Award.
Since 1999, Adam has served as a corporate member of Greater Boston Legal Services. He also serves on the Board of Directors of Jewish Family Service of Metrowest, and on the Board of Directors of the Framingham Historical Society and Museum.
