Practice/Industry Group Overview

For over seven decades, Akerman Senterfitt has been a leading provider of legal services to the financial community. Attorneys from our Banking and Lending Practice represent financial institutions, insurance companies, commercial credit companies, arrangers, and syndication agents that are based in Florida and throughout the United States. We handle multi-bank lending transactions and a wide array of other banking and lending activities.

We have significant experience in bank mergers and acquisitions and were instrumental in the formation and expansion, through multiple acquisitions, of one of the Southeast's leading bank holding companies. The attorneys in the practice are thoroughly versed in state and federal banking laws and regulations and routinely advise our bank clients in operational matters. As general counsel to the Florida Bankers Association, Akerman has been involved in drafting many of Florida's banking laws. Members of the Practice regularly interface with legislative and regulatory officials in shaping domestic and international banking policy.

Services Available

Our representation includes a variety of lenders in all types of loans and commercial credit transactions. In addition to expertise in traditional lending areas such as real estate, consumer, and corporate/business loans, our banking attorneys are recognized in many specialized lending arrangements such as asset-based, citrus/agribusiness, debtor-in-possession, health care, media, mortgage warehouse, securitized, and syndicated loans. We also handle such capital raising solutions as debt offerings, synthetic leases, and taxable and tax-exempt IDB's. Several members of the practice are listed in the Redbook and act as bond counsel, as well as counsel to lenders, issuers, trustees, credit enhancers, and underwriters, in connection with municipal and industrial revenue bond financings and other tax-exempt debt securities.

The firm advises lenders with regard to UCC, lender liability, and environmental law issues. Attorneys in our bankruptcy practice also represent lenders in loan workouts and bankruptcies and have been successfully involved on behalf of lending clients in many significant Chapter 11 reorganization cases.

Akerman's banking attorneys are recognized by the banks and market participants involved in large transactions. With the firm on the approved list for, and having served as underwriter's counsel to, Salomon Smith Barney and Raymond James, and with more former SEC attorneys than any other Florida firm, we have great credibility in the public and private markets.
