Recognizing how the digital age would revolutionize the practice of law, especially civil litigation, Ms. Faccone currently focuses her complex commercial litigation practice in the area of e-Discovery and all aspects of data preservation, privacy and records retention, both legal and technical.
Ms. Faccone is co-chair of McCarter & English's e-Discovery committee, and is well versed in all facets of electronic document discovery, including the viability, use and defensibility of advanced technology solutions. As a necessary corollary to that role, Ms. Faccone has a significant knowledge base on both the legal and technology aspects of data preservation and loss prevention, along with what are reasonable and defensible practices organizations should follow.
Ms. Faccone's expertise in the records management, electronically stored information and related arenas, has made for an industrious portfolio of experience as both a speaker and author on issues related to digital information and e-Discovery for a variety of national industry and professional groups Ms. Faccone is a member of The Sedona Conference Working Group Series 1 on Electronic Document Retention and Production and currently a member of the drafting team for the commentary on social media. She is knowledgeable on all aspects of social media governance in the current business environment including policy and regulatory issues affecting organizations' strategic planning as well as the unique considerations attendant to preservation, collection and production of social media in litigation.
Ms. Faccone has handled and enjoyed marked success in a broad spectrum of complex commercial litigation matters in all areas of business law, including breach of contract, breach of fiduciary duty, professional negligence, fraud, shareholder disputes, securities law violations and violations of governmental regulatory schemes. For example, she has successfully arbitrated a New Jersey shareholder oppression case involving a mortgage brokerage firm before a panel that included former New Jersey Supreme Court Justice Stewart Pollack. Ms. Faccone has significant experience defending healthcare clients under investigation for Medicare/Medicaid fraud and other related False Claims Act violations and successfully represented a New Jersey hospital in a major Medicaid Outlier investigation. At the conclusion of the case, her client was the only hospital in New Jersey not required to make any restitution payment to the Government. Ms. Faccone has also successfully represented many high profile clients including recovering more than $1 million on behalf of movie director Oliver Stone, obtaining a $12.4 million attachment in connection with a London arbitration on behalf of a large Middle Eastern telecommunications carrier, and defending a prominent New Jersey law firm in a multi-million dollar legal malpractice claim.
Ms. Faccone is chair of the Firm's Women's Initiative Steering Committee and Co-editor-in-Chief of the quarterly newsletter, Women in the kNOW. She is an active member of the National Association of Women Lawyers and also serves as an Advisory Board Member to the Women in Law Empowerment Forum. In addition, Ms. Faccone is a member of the Rumson, New Jersey Board of Education and serves as its Vice President.
