Amy Boyd assists business clients with a diverse array of environmental and administrative law concerns involving regulatory compliance, government advocacy and dispute resolution. Before joining Foley Hoag, Amy had considerable experience in both environmental policy and in direct political campaigns, giving her insight into practical strategies for permitting and other regulatory matters - particularly those involving environmental and energy concerns. Amy counsels clients on emerging issues from climate change and greenhouse gas regulations to environmental sustainability and corporate social responsibility. She also assists clients with insurance recovery and other commercial disputes, and advises on transactional issues.
While attending law school, Amy honed her dispute resolution skills by serving as a volunteer mediator with the Center for Conflict Resolution, working in the Cook County, Illinois Small Claims Courts. Her law school experience as an intern at the Environmental Law & Policy Center, Chicago, Illinois was an extension of her earlier interest in environmental law. Before entering law school, Amy managed political campaigns in New Jersey, Oklahoma and Texas.
Representative Experience
The following is a brief summary of Amy's experience and accomplishments:
· Represents clients seeking recovery of costs expended for the remediation of environmental contamination under M.G.L. Chapter 21E
· Represents several businesses pursuing insurers for reimbursement of defense and indemnification costs in connection with complex environmental liabilities
· Represents a medical device manufacturer in an effort to obtain reimbursement of more than $125 million from excess insurance carriers in connection with alleged device failure
· Represented regulated electric generator in suit regarding implementation of Regional Greenhouse Gas Initiative
· Represented clients in property tax abatement proceedings and negotiations with local and state agencies
· Successfully challenged the denial of air emission reduction credits by a state environmental agency
· Defended operators of institutions and industrial facilities, including recycled paper mills and power plants against enforcement actions brought by state and federal environmental agencies
· Represents clients in multi-party superfund enforcement and litigation actions
· Represents a developer in siting, permitting, and related litigation for a proposed 47 MW biomass facility
· Represented municipalities, manufacturers and institutions with respect to siting and closure of solid waste facilities
· Provides ongoing compliance advice to gas and oil-fired electric generating facilities
· Counsels energy and industrial corporations with respect to sustainability and environmental corporate social responsibility
· Represented the Buzzards Bay Coalition in a suit brought by the United States to invalidate state laws designed to prevent oil spills in sensitive waterbodies. Prevailed at the United States Court of Appeals for the First Circuit, creating new law regarding agency compliance with NEPA, United States v. Coalition for Buzzards Bay, 644 F.3d 26 (1st Cir. 2011)
