Andrea Gehman helps clients address employee benefits and ERISA matters related to 401(k) plans, pension plans, health and welfare plans, and executive compensation plans. Correspondingly, she directs clients on how to design, amend and administer these plans.
Andrea regularly counsels clients on the Patient Protection and Affordable Care Act, as well as COBRA, HIPAA (including HITECH), GINA and various other federal and state laws relevant to health and welfare plans. She also drafts and/or provides counsel on employment, change in control, and severance agreements, with a particular emphasis on compensation elements and associated tax implications, including Section 409A.
Andrea also advises clients on a range of labor and employment matters, including hiring practices, employment termination, discrimination charges, personnel policy review, employment contracts, consulting agreements, non-competition agreements, and severance and release agreements. She has experience working on compensation, benefits and employment issues associated with business transactions, including performing due diligence and negotiating and preparing contract provisions.
Prior to becoming an attorney, Andrea spent seven years managing retirement and welfare benefits at a large national law firm.
