Services Available
Lawyers in this practice group often represent debtors as well as creditors throughout the country. This national practice includes the representation of informal or ad hoc committees - in out-of-court restructurings and workouts. They also handle energy, telecom, real estate, chemical and healthcare work and collaborate with our banking and financial practice groups. Recent transactions include the successful restructuring of a number of companies with high yield debt outstanding.
Along with the above-mentioned aspects of bankruptcy law, our firm has a substantial practice assisting high-yield funds in buying and selling bankruptcy claims.
Bankruptcy Litigation
Litigation is often a necessary part of the bankruptcy process, and Andrews Kurth's lawyers are accomplished in all aspects of bankruptcy litigation including, among others, fraudulent conveyances, preferences, turnover, cramdown, stay litigation, valuation disputes, interpleaders, executory contract issues, and claim objections.
At the same time, we recognize that litigation is only a means to an end and not an end in itself. Since our goal is to represent our clients' best interests, our lawyers are equally adept at helping clients reach that end in the most advantageous, cost-effective manner possible - be it early settlement or a full-scale trial.
Commercial & Bankruptcy Reorganization
Andrews Kurth routinely represents debtors, creditors' committees, bank groups, equity committees, and trustees in large Chapter 11 bankruptcies. Adept at handling related litigation and negotiations, our recent representative client list is as diverse and vast as our experience.
In addition, Andrews Kurth has acquired industry expertise through our representation of:
- trade committees and debtors in large Chapter 11 cases;
- all parties in oil and gas and energy-related bankruptcies; and
- debtors, lenders and committees in industrial, healthcare and chemical bankruptcies.
