Practice/Industry Group Overview
The public law practice at Andrews Kurth is generally divided into three areas: public finance; the general or special representation of local government entities; and litigation involving public sector issues.
Public finance attorneys in the Houston, Dallas and Austin offices serve as bond counsel or disclosure counsel for state agencies and cities, counties, school districts and special authorities throughout Texas. Those attorneys also represent major national and regional investment banking firms as underwriters of tax-exempt bonds.
Most transactions require the expertise of the firm's tax lawyers and many financings are of a unique or innovative nature, which often require the experience of the firm's real estate and corporate securities attorneys. In some instances clients engage the firm for assistance in the enactment of new legislation at the state or local levels. The 2002 Corporate Scorecard, a national survey compiled by The American Lawyer, ranked our public finance underwriters' counsel practice 18th for number of municipal bond issues and 19th for bond proceeds.

The firm's public finance work involves a full range of tax-exempt bond transactions, from general obligation bonds to traditional revenue bonds to private activity bonds. Many clients are active in the issuance of debt for both new projects and refinancing existing facilities and programs. Areas of public finance specialization include education, transportation and toll road, water and sewer utility, aviation, port, convention center, sports an entertainment facility, housing and tax increment transactions. We are experienced in fixed and variable/adjustable rate structures, commercial paper programs, lease/purchase, swap and derivative transactions. We represent domestic and foreign commercial banks as issuers of credit enhancement and liquidity facilities and as trustees in various types of public debt financing.
Work for the Port of Houston includes real estate, environmental, public contracting, administrative, legislative and litigation matters. We also serve as special counsel to cities, counties and special districts in a variety of matters, including election, redistricting, annexation, civil rights, procurement and construction, real estate and joint public/private development matters.
The firm maintains an active litigation practice involving public law issues in state and federal courts at both the trial and appellate levels. Our clients include local governments, corporations and individuals. Public law attorneys routinely handle specialized issue litigation and high-profile cases for our clients.
