Anne MacLean concentrates her practice in all areas of commercial litigation, including disputes involving contract law, commercial and individual tort law and constitutional law. Ms. MacLean is licensed to practice in Kentucky and Indiana.
Representative Matters
· Won summary judgment on behalf of a large banking client involving claims under the Uniform Commercial Code for a fraudulent checking account and an amount in controversy totaling nearly $400,000. The court granted the banking client's motion for summary judgment in its entirety.
· Won summary judgment on behalf of a limited liability company suing the seller of business interests for breach of warranties made in the purchase and sale agreement.
· Successfully defended a large commercial freight company against plaintiff landowners claiming personal injury and property damage purportedly arising from environmental contamination. After receiving our client's motion for summary judgment, the plaintiffs' counsel voluntarily dismissed our client from the litigation.
· Won motion to dismiss and related appeal on behalf of a national alcoholic beverage wholesaler client seeking new state operating permits. A competing business sought to challenge the administrative agency's decision to allow the client's new in-state operations. The challenge was dismissed and the court of appeals upheld the dismissal.
· Defended national retail client against a plaintiff customer's tort claims. The court granted the retail client's motion for summary judgment on key issues, dismissing the plaintiff's claims for vicarious liability and punitive damages.
