Biography

Anthony Pagano concentrates in construction law, complex construction litigation, construction defect and products liability litigation, commercial litigation and civil and criminal trial practice. An aggressive and seasoned litigator, Mr. Pagano has successfully represented his clients in motions hearings, trials, depositions, mediations and negotiations across the country at both the state and federal level. In addition, Mr. Pagano has extensive experience in counseling, drafting and negotiating contracts for complex multi-million dollar construction projects.

Mr. Pagano has many years of litigation experience from case onset through discovery and trial. His investigatory skills are finely honed, and he possesses a keen ability to recognize and account for critical issues before they develop, which often results in a strategic advantage for litigation clients and assists contract clients in avoiding or anticipating future pitfalls. He brings with him a practical understanding of technical construction matters and an attention to detail which is an asset to his clients in this often highly technical area of the law.

Representative Clients

Mr. Pagano is widely experienced in all types of civil and criminal litigation and represents both companies and individuals. Most recently, Mr. Pagano has obtained dismissals of claims asserted against his clients in various commercial litigations. He has successfully represented his clients in significant Grand Jury investigations, trials and related criminal proceedings. Further, Mr. Pagano was a principal litigator successfully prosecuting and overseeing the development of a nationwide construction and product defect litigation on behalf of a prominent national hotel chain, with tens of millions of dollars in dispute and involving a myriad of construction defect, products liability, and business tort issues. In addition, Mr. Pagano has been responsible for drafting, negotiating and counseling nearly half a billion dollars in construction agreements for national hotel developers, building owners, contractors and others. He regularly counsels his clients on construction issues, including contract liability, damages, warranties and potential claims.

Significant Matters

Following a six-week jury trial in Massachusetts, Mr. Pagano along with Len Goodman and Greg Brown recently tried and won a significant jury verdict in the critical spearhead case of their client's national construction litigation. The verdict was reported in the October 31, 2005 issue of Massachusetts Lawyers Weekly. Then, the Venable trial team began the second of these jury trials in Federal Court in Pennsylvania, forcing an extremely favorable resolution of the entire litigation prior to verdict. Mr. Pagano and Carol Elder Bruce again received media attention for obtaining an all-counts "Not Guilty" jury verdict in a major bribery case against the Maryland Attorney General's Office. Most recently, Mr. Pagano has represented clients in significant government investigations and negotiates multi-million dollar construction contracts on a regular basis.

Mr. Pagano has been a member of several bar associations and forums, including the American Bar Association's Forum on Construction Law and Committee on Criminal Litigation, and of several construction industry groups including the Washington Building Congress, the Construction Specifications Institute, the American Society of Testing & Materials International (Committee on Building Performance), and the Boston Society of Architects (Committee on Building Performance).
