Biography

Ashley Bailey is a counsel in the Washington, D.C. office of Crowell & Moring and a member of the firm's White Collar & Regulatory Enforcement Group. Her focus is white collar criminal defense and regulatory compliance. She has sub-specialties in the Foreign Corrupt Practices Act, and environmental investigations and prosecutions, and she leads the Firm's federal lobbying and campaign finance compliance practices.

In the regulatory compliance component of her practice, Ashley assists members of the Fortune 100, major colleges and universities, trade associations, non-profit organizations, and top-tier law firms. Ashley routinely assists clients in developing compliance programs in areas such as the Foreign Corrupt Practices Act, Lobbying Disclosure Act, Foreign Agents Registration Act, federal campaign finance laws, and government ethics rules and regulations.

In defending against criminal allegations, Ashley represents individual and institutional clients through all phases of criminal litigation, including pre-indictment, trial, sentencing, appeal, and petition for pardon or clemency. Most recently, Ashley has been involved in investigations, trials, and contested sentencing proceedings in matters of alleged commercial and foreign bribery, public corruption and lobbying violations, business fraud, and environmental/natural resources crimes. In the past several years, Ashley has represented executives and management boards in the throes of three major FCPA investigations led by the United States Department of Justice and Securities and Exchange Commission. She recently represented a high-profile member of Congress in an investigation by the Department of Justice and also represents corporations in Congressional investigations. Ashley also boasts the rarely-granted Presidential Pardon among her successes for clients.

Prior to joining Crowell & Moring, Ashley was a Trial Attorney for the United States Department of Justice where she served as lead counsel on a number of federal appeals and participated in numerous trials involving claims of upwards of $1 billion. Ashley received the Assistant Attorney General's "Rookie of the Year" Award for exceptional performance while with the Department. She also clerked on the Independent Counsel investigation of Department of Interior Secretary Babbitt and for the United States Attorney's Office for the District of Columbia.

Ashley served two terms as Co-Chair of the Steering Committee for the Criminal Law and Individual Rights Section of the D.C. Bar and remains a member of the committee, a position for which Ashley was elected twice by her peers. She also is a Co-Chair of the Environmental Crimes Subcommittee of the American Bar Association's White Collar Crime Committee. She graduated magna cum laude and with honors from Georgetown University where she was nominated for the Rhodes Scholarship. She received her law degree cum laude from Georgetown University Law Center where she was a research assistant to White Collar Criminal Law professor Julie O'Sullivan; a member of the National Moot Court team; winner of the Weschler First Amendment Moot Court Competition; recipient of the graduate awards for both commercial law and appellate litigation; and an editor to The Tax Lawyer. Ashley also received the International Trial Lawyer's Award for her representation of indigent defendants in the Fourth Circuit and is a member of the Phi Beta Kappa honors society.

Ashley is admitted to the United States Supreme Court. The United States Court of Appeals for the Fourth and Federal Circuits, the United States District Court for Eastern District of New York, and the United States Court of Federal Claims are among the federal courts in which Ashley has argued. Ashley most recently completed a five-week jury trial in a white collar matter in the United States District Court for the District of Maryland.
