Practice/Industry Group Overview
Our attorneys have significant experience in defending class actions across a variety of industries and legal issues. We often counter the actions of plaintiffs in wrongful death or injury cases who conduct "forum shopping" in venues with no direct ties to their accident claims. Because these liability claims frequently seek class action status, our lawyers have developed effective defense strategies, for example, helping a tire manufacturer develop a nationwide strategy for coordinating discovery in products liability lawsuits. Additionally, our firm's insurance attorneys are known nationally and internationally for their skill and record of success in representing insurance company clients, which includes representing major insurance companies in complex coverage issues that involve class actions, counseling them from discovery through trial and appeal.
Selected examples of our class action representation include the following:
- Represented foreign and domestic automotive manufacturers in a large class action case involving alleged brake and brake pad defects in one of their SUV models manufactured in the U.S. and Japan over a several-year period
- Represented an international automobile manufacturer against nationwide class action claims
- Represented a leading auto manufacturer in a nationwide class-action alleging defective brake systems on luxury vehicles
- Represented the maker of a prescription diabetes medication which was withdrawn from the market and the attendant legal issues arising out of that action
- Represented a wireless telephone service provider in defending a class action
- Represented an insurer in a fraud lawsuit seeking hundreds of millions for the insured's alleged damages in settling various class actions
- Represented a boiler manufacturer in class action litigation resulting from chemical plant explosion
- Represented a chemical company in a class action involving the purchase of natural gas
- Represented a major automobile manufacturer in class action and market representation matters
- Defended a class action seeking damages for gas pricing and ratable takes by moving to strike and to enjoin the plaintiffs' expert from testifying based on breach of a confidentiality agreement
