Brenda C. Swick is a partner in our Litigation Department. She is a member of the International Trade & Investment Law Group and the co-chair of the National Procurement Group. Her practice includes international trade and investment law (including WTO dispute settlement), government procurement, export controls and economic sanctions, trade remedies, anti-corruption, customs law and judicial review of government decisions. Ms. Swick was formerly legal counsel with the Government of Canada, Canadian International Trade Tribunal and in-house counsel to a major freight forwarder and distribution company. Ms. Swick is well-known in government circles, and brings to clients years of experience in dealing effectively with governments and administrative agencies.
Ms. Swick is ranked as a leading practitioner in the areas of Public Procurement, International Trade and WTO challenges in the 2011 edition of the Chambers Global: The World's Leading Lawyers guide. She is recognized in Euromoney Legal Media Group's 2011 Guide to The World's Leading International Trade Lawyers and the 2011 Guide to the World's Leading Women in Business Law. Ms. Swick appears in the 2011 edition of Lexis-Nexis Martindale Hubbell Peer Review Ratings.
The Government of Canada has appointed Ms. Swick as an expert arbitrator to review duty determinations under Chapter 19 of the NAFTA.
Ms. Swick regularly represents clients in mandates relating to:
· dispute settlement under and compliance with international trade agreements, such as the NAFTA and WTO;
· government contracting at all levels (federal, provincial, and municipal) including bid preparation, contract negotiation, regulatory compliance, and bid challenges before the courts and administrative agencies (she was formerly legal counsel to Canada's bid review authority);
· export controls and economic sanctions regimes, advising clients on matters ranging from preventive work to compliance and enforcement matters;
· anti-corruption laws, advising clients on matters ranging from preventive work to representation in internal investigations and enforcement matters worldwide;
· investor-state claims under Chapter 11 of the North American Free Trade Agreement (NAFTA);
· domestic regulatory investigation and compliance matters including competition, supply management regimes, health, agricultural and consumer products regulation, food, drug, cosmetic and consumer product recalls, transportation, privacy, records management, and access to information;
· customs law including rules of origin, value for duty, export and import quotas, and tariff classification;
· trade remedy investigations including the application of anti-dumping, countervailing or safeguard duties;
· judicial review of administrative action, representing clients before the Federal Court and quasi-judicial administrative tribunals.

· represents the BC Coastal Forest Industry with regard to the export of logs to China, the US, and other jurisdictions;
· represented the Government of Chile in the market access negotiations for the Canada-Chile Free Trade Agreement;
· represented the Canadian Commissioner of Competition before a binational panel established under Chapter 19 of the NAFTA;
· represented a major supplier of military equipment in a public procurement and in subsequent transactions subject to Canadian and US economic sanctions and export controls;
· represented a major telecommunications service provider and successful bidder in a challenge of a contract award before the Federal Court of Canada;
· represents a major dairy manufacturer regarding Canadian and provincial regulatory and supply management, customs, advertising and import quotas;
· appearances before courts including the Federal Court in relation to judicial review of government action;
· appearances before binational panels established under the NAFTA to challenge US government measures imposed on Canadian exports;
· represents major mining and resource companies in matters relating to compliance Canadian anti-corruption laws;
· represents a leading oilfield services provider, in matters relating to compliance with Canada's export controls and economic sanctions regime;
· represents a major global food producer in regulatory compliance matters, including the Canadian Food Inspection Agency;
· represents a major Canadian softwood lumber corporation with regard to compliance with anti-bribery legislation and with regard to exports to and operations in China;
· represented a remanufacturer of softwood lumber in a challenge before the Tax Court of Canada regarding the application of export duties on exports to the US;
· advises clients in a variety of sectors regarding the action to be taken to protect and promote their company's interest in the regional free trade agreements being negotiated between Canada and other countries;
· represented a major distillery in an anti-dumping and countervailing duty case regarding Grain Corn from the US;
· represented a major exporter and importer of infants' foods in Canadian anti-dumping proceedings, including reviews before the Federal Court and binational panel under Chapter 19 of the NAFTA;
· represents a major global food manufacturer in all matters regarding Canadian regulatory approvals, including test market authorizations, advertising and marketing compliance and customs;
· represented a major pharmaceutical company before the CBSA and Federal Court in a tariff classification and rules-of-origin verification regarding imports from the US and Germany and New Zealand;
· represents softwood exporters to the US with regard to obtaining necessary export permits and quota from federal authorities; and
· represents a major financial institution regarding the application of foreign extraterritorial blocking measures.
Ms. Swick is the Vice-Chair to the International Procurement Committee of the American Bar Association Section of International Law (ABA International). She is a member of the Executive of the Trade Law Committee of the International Bar Association, and past chair of the International Law Section of the Canadian Bar Association. She is a member of the American Bar Association, International Law Association, and American Society of International Law. Ms. Swick is a member of the Board of Editors of the Federated Press publication, Regulatory Boards and Administrative Law Litigation, and a contributing editor to the North American Corporate Lawyer.
She is also a member of the Board of the Canadian Institute of Child Health.
Ms. Swick received her Bachelor of Social Sciences (Honours, Economics) in 1981, and her Bachelor of Law from Queen's University in 1985. She was awarded the David Sabbath Prize for the Taxation of Trusts and Estates. She was called to the Ontario bar in 1987.
