Brian has spent his career building a diverse civil trial practice. Over the past 28 years, he has tried a broad range of cases, taking more than 75 of them to verdict. In recent years, his trial practice has focused on defending physicians and other professionals in professional negligence cases. He also has significant experience with employment liability, product liability and complex commercial litigation. The issues Brian has handled range from allegations of brain damage at birth to a near-meltdown at a nuclear power plant in Ohio caused by alleged poor engineering. Brian has tried many cases on behalf of employers in federal and state courts, and has represented employers in numerous proceedings before the Illinois Human Rights Commission and the Equal Employment Opportunity Commission, as well as in arbitration cases. Brian has also lectured before and presented to Illinois State Bar Association continuing legal education programs, medical groups and insurers on a number of legal issues, including trial practice; injunction and restraining order actions; employment practices; risk management; patient confidentiality; and records management and maintenance. Rosen, M.D. - Lake County, Ill., 2010 Brian won this case for a surgeon accused of negligently performing a surgery that resulted in the patient's bowel perforation, sepsis and death. The plaintiff asked for at least $2 million. Cunningham v. Stern, M.D. - Cook County 2010 A doctor was accused of failing to do a cardiac workup on a patient, causing a fatal cardiac arrhythmia in the patient three days after leaving the hospital. The plaintiff asked for $5 million, but Brian secured a jury verdict in favor of the doctor. Galowich v. Midwest Diagnostic Pathologists, S.C. - Cook County 2008 This pathology practice was accused of causing the unnecessary resecting of a patient's colon after the patient's cancer misdiagnosis. The plaintiff asked for $11 million, but a jury ruled in favor of the defendants, whom Brian represented. RMA, Wramsco v. Cory & Associates - Cook County 2007 The plaintiffs in this case, which involved breach-of-contract, professional negligence and interference claims, sought $2.5 million at trial. Brian succeeded in limiting the net jury verdict to $13,000. Cardona v. Del Granado, M.D. - Cook County 2006 The defendant faced a negligence lawsuit for an alleged delayed delivery of a baby, who suffered severe brain damage. The plaintiff sought more than $33 million from the jury, but the doctor, whom Brian defended, paid nothing. Araujo v. Leong, M.D. - Cook County 2005 Brian won this case for a doctor accused of performing a delayed delivery on a baby, leading to the child's cerebral palsy and brain damage. The plaintiff sought $17.5 million from the jury. Obradovic v. Stankovic, M.D. - Cook County 2005 A doctor's alleged negligence in this case caused a patient to bleed to death after a neck biopsy. The plaintiff asked for more than $1 million, but Brian convinced the jury that the doctor was not at fault. |
