Brian Henninger's practice focuses on infrastructure development and construction disputes. Brian also has extensive experience in insurance recovery and counseling, property disputes and complex tort/products liability.
He works with public and private entities on all aspects of infrastructure development and delivery. He assists clients with pre-construction planning, permitting and procurement issues as well as contract structuring and negotiation. Brian is a knowledge leader in the public-private partnership market emerging in the Massachusetts transportation sector. He has experience with traditional, alternative and "mega" modes of project delivery, including design-build-finance-operate-maintain, design-bid-build, design-build, integrated project design and implementation of "lean" construction tools.
Brian's construction disputes practice covers a broad spectrum of the industry, including major infrastructure projects, commercial facilities and private and public housing projects. He represents both owners and contractors in lawsuits and ADR proceedings, including the ICC, AAA and other arbitration programs. Brian has successfully negotiated nine figure claims for equitable adjustment to seven figures in mediation and recovered millions of dollars on behalf of individual home owners. As an adjunct to his construction work, Brian counsels retail companies and property managers on numerous disputes arising from use and/or ownership of commercial and residential property, such as personal injury claims, commercial lease disputes and property damage caused by design defects.
Brian is a seasoned insurance recovery litigator who works extensively with clients to resolve coverage disputes involving construction, property and mass/complex tort liabilities. He represents insured clients in lawsuits and ADR proceedings seeking recovery under various lines of property and casualty insurance with special emphasis on general and umbrella liability insurance. Brian also works with risk managers on the development and implementation of efficient and reliable policy compliance programs.
In addition, Brian maintains an active complex tort and products liability practice. He has extensive experience representing pharmaceutical drug manufacturers in both state and federal courts, including the Multi-District Litigation Panel. Brian also has experience devising creative and cost-effective strategies for extricating a variety of clients from mass tort litigation in Massachusetts and elsewhere.
