Brian Gocial concentrates his practice in government contract law at the federal and state level. He services a wide range of clients in areas such as:
· Pre- and post-award bid protests before the Government Accountability Office, the Court of Federal Claims, the Federal Aviation Administration's Office of Dispute Resolution for Acquisition, as well as state agencies and courts;
· Small business size status protests before the Small Business Administration's Office of Hearing and Appeals and the Federal Aviation Administration's Office of Dispute Resolution for Acquisition;
· Requests for equitable adjustments under federal and state law;
· Contract claims before federal and state agencies, federal district and appellate courts, and boards of contract appeals;
· Proposal preparation;
· Drafting of subcontracts, joint venture and teaming agreements;
· Implementation of mandatory disclosure and ethical compliance programs;
· Grants and cooperative agreements;
· Suspension and debarment issues.

Representative Matters
· Represented major United States Department of Defense logistics contractor in bid protests before the GAO concerning contracts awarded in support of Iraqi operations.
· Successfully represented chemical warfare decontamination contractor in defense of overpayment dispute with the United States Army Space & Missile Defense Command.
· Prosecuted pre- and post-award bid protests on behalf of a leading national wholesale distributor against the United States Air Force, resulting in favorable agency corrective actions.
· Successfully defended small women-owned business size protest based on affiliation before the FAA's ODRA.
· Overturned City's termination for default under a United States Economic Development Administration grant, and repealed prospective high-risk designation for future grant applications.
· Overturned finding of nonresponsibility by state agency against leading national collections company.
· Successfully defended award by Commonwealth of Pennsylvania of telephonic translation services contract against competitor's allegations that awardee improperly classified translators as independent contractors and was not a bona fide small business in both administrative bid protest proceeding and appeal before the Commonwealth Court.
· Successfully challenged a decision by the U.S. Army Engineering & Support Center to not award an indefinite delivery/indefinite quantity contract to client for the performance of Worldwide Environmental Remediation Services ("WERS") at various former defense sites and active Department of Defense installations. The Army took corrective action and awarded an indefinite delivery/indefinite quantity contract to client with a shared ceiling value of nearly $1 billion.
· Successfully defended award of IT services contract by Commonwealth of Pennsylvania against competitor's allegations of technical non-compliance.
· Presented at federal and state government contract trainings on behalf Federal Publications Seminars, Congressman Joe Sestak's (PA-D) Small Business Development Forum, and National Contract Management Association and the Temple University Small Business Development Center.
Community Service & Affiliations
Mr. Gocial is a member of the board of directors for the Delaware Valley Chapter of the National Defense Industrial Association, and the board of directors for the Greater Philadelphia Chapter of the National Contract Management Association. He also serves as solicitor for the Montgomery County Democratic Committee in Norristown, Pennsylvania.
