He has had extensive dealings with the Kentucky Department of Revenue, the Kentucky Public Service Commission and the Kentucky Insurance Department. He actively tracks and promotes tax and other economic legislation before the Kentucky General Assembly. Mr. Clark served as lead counsel to the taxpayer in a national precedent-setting case on the right of a unitary, multi-corporate group to file a combined state tax return. He also was successful in overturning an unconstitutional Kentucky motor vehicle tax, reaping a multi-million dollar recovery for the state's trucking industry. Recent Assignments · Served as lead counsel in a complex takings case before the U.S. Court of Federal Claims in Washington, D.C. · Prevailed in class action for Kentucky corporate taxpayers on the constitutionality of license tax statutes. The result was tax refunds and an abatement of the assessments at more than $30 million. · Served as co-lead counsel in extensive utility contract litigation between large international companies.
