Biography

Joe is a civil trial lawyer on the firm's Real Estate, Development & Construction team. With extensive first-chair jury trial experience, his practice is focused on resolving disputes in the real estate and construction industries. He has also assisted energy and healthcare clients on similar matters. He represents owners, developers, design professionals, contractors, subcontractors and suppliers in the areas of litigation, arbitration, mediation and negotiation. In handling these complex matters he has gained a thorough understanding of the technical issues and the insurance coverage matters typically applicable to large industrial, commercial and residential projects as well as healthcare facilities. Joe's representation of real estate clients has included:

•Representing owners of a condominium project through litigation, mediation and settlement of construction defect claims in excess of $15 million.

Defending an engineering firm through favorable summary judgment against claims by contractor on a highway project with $6 million in damages from alleged design defects and negligent misrepresentation.

Leading negotiations for a hotel owner to require protective measures and guaranteeing compensation for anticipated impacts of demolition by implosion of neighboring 17-story building.

Defeating an application for a Temporary Restraining Order against a major international gas pipeline based on alleged trespass and claims for inverse condemnation by landowner along right of way. Achieved settlement in mediation.

Outside of real estate work, Joe has also represented various Fortune 500 energy companies in defending multi-million dollar seismic damage claims, excess royalty claims, inverse condemnation claims and take-or-pay claims.

Joe is Board Certified by the Texas Board of Legal Specialization in Civil Trial law. He is also a frequent speaker at professional seminars on litigation of construction defects, mechanics lien claims, bond claims, collections and creditors' rights issues, and other topics. His writings have been published by The University of Texas School of Law, Continuing Legal Education Department, The State Bar of Texas, The Construction Law Section of the State Bar of Texas, Texas Builder, and Austin Construction News. Prior to joining Husch Blackwell, Joe practiced with Brown McCarroll.

Represented owners of a 30-story luxury residential condominium project in Houston, Texas, through litigation, mediation and settlement of construction defect claims in excess of $15 million against contractors and subcontractors, and through settlement of declaratory judgment action filed by the project insurer.

•Defended engineering firm through favorable summary judgment against claims by contractor on highway project with $6 million in damages from alleged design defects and negligent misrepresentation.

•Handled the litigation, mediation and settlement of claims by a highway contractor against a quality control and quality assurance consultant for negligence in connection with specification compliance verification in stay-in-place concrete form construction of multiple bridges in El Paso, Texas.

•Obtained insurance coverage for exclusive Santa Fe, N.M., property owners' association to provide defense and indemnity against claims by association member whose home was extensively damaged by soil movement after building plans and soil report were allegedly approved by the association.

•Defended engineering firm through mediation and suit settlement with a developer over alleged defects in subdivision infrastructure design.

•Represented an Austin condominium homeowners association and 76 individual condominium unit owners in litigation, mediation and settlement of construction defect and mold claims against developer, general contractor, subcontractors and the homeowners' insurance carrier.

•Negotiated design-build contracts for construction of a special events center project for a Texas municipality.

•Represented a general contractor through a jury trial regarding a construction defect and payment dispute with the owner of a taxi service headquarters building.

•Represented a general contractor through a jury trial in dispute with a subcontractor over claimed breach of contract on a Visitor Information Center project.

•Achieved a settlement for the owner of Women's Clinic of payment and lien claims asserted by a contractor.

•Represented a school district through litigation, mediation and settlement of construction defect and mold claims against design professionals, contractor and subcontractors on high school classroom building and gymnasium project.

•Lead multi-district litigation in defense of garnishment claims against several Delaware corporations doing business with a government-owned oil and gas corporation in the Far East.
