Chad McTighe is a Member in the Louisville office. He is a member of the Business Litigation Service Group and the Class Action Defense and Appellate Advocacy teams. He represents clients in a wide range of business and commercial litigation matters, including extensive practice in class action litigation, shareholder and membership disputes, and fiduciary duty litigation. He is BV® Distinguished Peer Review Rated in the Martindale Hubbell Law Directory.
Recent Assignments
· Defeated Plaintiffs' effort to certify a class of current and former employees in litigation involving alleged violations of Kentucky wage and hour laws and obtained decertification of collective action involving parallel claims under the Fair Labor Standards Act. Oetinger v. First Residential Mortgage Network, Inc., 2009 U.S. Dist. LEXIS 61877 (W.D. Ky. July 16, 2009)
· Briefed and argued appeal involving standards concerning fiduciary duty and diversion of business opportunities for limited liability companies, matters of first impression in Kentucky, resulting in a published Kentucky Court of Appeals opinion, Patmon v. Hobbs, 280 S.W.3d 589 (Ky. App. 2009)
· Currently defending numerous class actions involving a variety of claims relating to insurance and annuities.
· Counsel for Plaintiff in litigation involving covenant not to compete, fiduciary duty, and trade secrets. Gardner Denver Drum, LLC v. Peter Goodier and Tuthill Vacuum and Blower Systems, 2006 U.D. Dist. LEXIS 20703 (W.D. Ky. 2006).
· Obtained summary judgment for Defendants on ERISA claims in Cheryl Hall and Judith Smith v. Baptist Healthcare Systems, Inc. Restated Retirement Plan and Baptist Healthcare System, Inc., 2007 U.S. Dist. LEXIS 78243 (W.D. Ky. 2007).
· Member of a team of lawyers involved in complex environmental remediation litigation, and one of the drafters of summary judgment briefing. See Westlake Vinyls, Inc. v. Goodrich Corp., 518 F.Supp. 2d 902 (W.D. Ky. 2007) and Westlake Vinyls, Inc. v. Goodrich Corp., 518 F.Supp. 2d 918 (W.D. Ky. 2007).
Before Stites & Harbison
During law school, Chad worked as a summer associate at Stites & Harbison. He was an assistant rector of O'Neill Family Hall (2002-04) at the University of Notre Dame. While in college, Chad worked for three summers as an intern in information technology at Stock Yards Bank & Trust in Louisville and as a resident assistant at Notre Dame for one year.

Chad is a member of the Board of Directors of the Kentucky Derby Festival Foundation. He also serves as a volunteer attorney representing victims of domestic violence. He regularly participates in numerous other volunteer activities, including the American Cancer Society Relay for Life
