Mr. Stanziale's concentration over the past 40 years has been in the area of financial restructuring, insolvency and creditors rights. Mr. Stanziale has represented Debtors, Trustees, Creditor's Committees, Banks and other secured parties. He has been appointed by the Department of Justice (Office of the United States Trustee) as operating Trustee in numerous Chapter 11 Cases and in liquidating Chapter 7 matters.
Among the higher profile matters, Mr. Stanziale is presently Debtor's Co-counsel (with Weil Gotshal & Manges LLP) representing the Trump Entertainment Resorts in its Chapter 11 reorganization restructuring of $1.8 Billion of debt. He is Trustee of Tower Air, Inc., which airline he operated in Chapter 11 for seven (7) months utilizing five (5) B-747's aircraft on worldwide charter. He was Debtor's counsel to Port Liberte'; a unique real estate development on the Hudson River; he acted as Debtor's counsel to Arrow Carrier (a nationwide trucker), and was bankruptcy counsel to John Z. DeLorean. He was Trustee and counsel for Kiwi International Holdings (which operated as Kiwi Airlines); Muller Tours (a large New York-based tour bus operator); he is counsel to the Trustee for SkyView Media Group, a satellite transmitter of foreign television programming and Pappas Telecasting, a group of 14 television stations. All of the above matters carried debt in the multi-millions of dollars and their administration required business judgment as well as complex litigation.
Presently, Mr. Stanziale is Chapter 11 Trustee in the matter of Solomon Dwek and multiple affiliated enterprises. He presides over the liquidation of more than 350 properties and 120 law suits. It is one of the largest Ponzi scheme cases in the United States and with implications of massive money laundering and political corruption.
Mr. Stanziale is a former judge of the Newark Municipal Court and former Assistant Corporation Counsel for the City of Newark.
He serves on the Judicial Selection Committees for both the Bankruptcy Court and the United States District Court for the District of New Jersey. He is on the United States Trustee's Panel for the District of New Jersey. He has participated in Bench Bar panels for the American Bar Association; American Bankruptcy Institute and the New Jersey State Bar Association.
Other matters: Mr. Stanziale is Chapter 7 Trustee for MUMA Services Inc. a/k/a Holt Marine Terminal Services, on east coast stevedoring, shipping and warehousing operation. He is also Chapter 7 Trustee for Student Finance Corp., $750,000,000 in securitized student loans involving massive fraud, conspiracy and other deceptive practices. Chapter 7 Trustee for Allserve Systems Corp., a case spawned from a scheme to defraud lenders on a sale and leaseback of worthless telecommunications equipment in the United States, India and the U.K. and involved losses of over $185,000,000.00. He is Litigation Trustee for creditors pursuant to a Liquidating Trust for Able Laboratories, Inc. a large generic drug manufacturer shut down by the FDA for mislabeling and fraud; Old Ladder Co. (DE), Inc. f/k/a Werner Ladder Co., (DE), Inc. et al, Custom Foods Liquidating Estate, USBC De.
Mr. Stanziale has been recognized as a New Jersey Super Lawyer for 2007-2012 and is Peer Review Rated A.V. by Martindale Hubbell. He has also been recognized as a Chambers USA "Leaders in their Field" lawyer for 2011 and 2012.
