Clark Cooper is a Partner in the Creditors Rights & Bankruptcy and Litigation practice groups of the firm's Birmingham offices.
Cooper has represented clients in a wide variety of litigation including creditor and lender rights matters and concerns, construction disputes, class actions, fraud claims and significant insurance claim cases. Cooper has also litigated cases involving significant personal injury and wrongful death.
Cooper is a member of the American Bar Association, Birmingham Bar Association and has been recognized by The Best Lawyers in America, Birmingham Business Journal's "Best of the Birmingham Bar," and Benchmark Litigation's list of Alabama Future Litigation Stars. Cooper is also serving his second term as the Alabama State Delegate to the American Bar Association's House of Delegates, and he is a Fellow of the American Bar Foundation.
Cooper received his Bachelor's degree in Political Science from Wake Forest University and his Juris Doctorate from The University of Alabama School of Law. During his spare time, Cooper works with the Birmingham Hospitality Network to provide food and shelter to families in need, and he volunteers with Habitat for Humanity.
Representative Experience
· Defended an international corporation in a multimillion dollar case involving allegations of fraud and construction defects related to the construction of a large food processing plant.
· Defended a national construction company in a suit alleging claims of wrongful death.
· Defended a national financial institution from allegations of improper lending practices. Claims against the financial institution were dismissed and the financial institution received a significant payment on its counterclaim.
· Defended an international shipping company in Los Angeles, California from multimillion dollar claims for breach of contract and fraud.
· Defended a national insurer against a putative class action for federal securities fraud and various state law claims, including RICO. The Eleventh Circuit Court of Appeals affirmed the dismissal.
· Defended a national oil and natural gas company from claims of discrimination.
· Defended a national contractor on a commercial development from claims of liquidated damages and improper workmanship. Obtained over $1 million for the contractor from the owner.
· Defended an international building contractor from more than $20 million in claims of faulty construction resulting in shifting and cracking of a large commercial building.
· Defended a national health care provider from claims of wrongful death.
· Defended an international products manufacturer from claims of multiple wrongful deaths and brain injury.
