Attorneys in Cohen Seglias’ Creditors’ Rights Group represent both creditors and debtors in state and federal courts, out-of-court workouts, loan restructuring, collection and a wide spectrum of other matters. We have significant expertise and experience in construction and real estate matters and provide a wide range of other services to creditors in commercial areas including biotech, health care, hotel and leisure, meat-packing, manufacturing, pharmaceuticals, plastics, real estate, retail, telecommunications, and the trucking business. We also regularly represent creditors in breach of contract actions, obtain judgments on their behalves and seek to collect upon the judgments obtained for our creditor clients including utilizing real estate foreclosures.
Our attorneys have experience using state and federal court receiverships as a cost-effective alternative to foreclosure or bankruptcy. We collect significant sums for traditional lenders by causing the appointment of a receiver to obtain control and to liquidate the collateral securing the payment of loans in default. We also use receivership proceedings to obtain strategic results on behalf of our clients. For example, we recently caused a receiver to be appointed to transfer the title to real property from one corporate entity to its affiliate, where the transferor had been dissolved for a number of years but still held title to the real property.
