Biography

Conrad Anderson IV is an Associate in the Birmingham office where he is a member of the Litigation section. Mr. Anderson received his Bachelor of Arts in Political Science from The University of Mississippi, magna cum laude, in 2003, where he was a member of Phi Beta Kappa. He earned his J.D. from The University of Mississippi School of Law, magna cum laude. While in law school, Mr. Anderson was a member of the Moot Court Board and the NTC National Trial Team. He also served as President of the Law School's chapter of the Mississippi Defense Lawyers Association.

Construction Litigation

Conrad represents owners, developers, general contractors and material suppliers on all aspects of construction litigation, including the preparation and review of contract documents, change order disputes and negotiations, payment disputes and the filing and defense of mechanics' and materialmen's liens. Conrad has experience methodically resolving the complex disputes that arise between contractors, suppliers, architects and engineers in state and federal court proceedings as well as in AAA arbitrations under the construction industry rules. Some of his representative matters include the following:

· Successfully tried breach of contract case on behalf of subcontractor against general contractor.

· Represented contractor defending claims brought by subcontractor for extra time and material, and other claimed amounts owed.

· Numerous cases representing contractors and subcontractors to perfect and enforce liens and seek payment and damages for breach of contract.

· Defended subcontractor against claims of homeowners and general contractor arising out of residential construction project.

Business Litigation

A substantial portion of Conrad's practice is devoted to representing individuals and various business entities, including banks, broker-dealers, securities-licensed individuals, accounting firms, insurance companies, credit reporting agencies and debt collection companies, in state and federal court proceedings as well as FINRA arbitration forums. Conrad's experience includes:

· Defending individuals accused of violating non-compete agreements.

· Representing regional bank pursuing multi-million dollar claim in Multi-District Litigation (MDL) proceedings seeking damages arising from fraudulent investment.

· Defending individuals and broker-dealers in FINRA arbitrations.

· Defending insurance companies against breach of contract and bad faith claims.

· Defending lenders and mortgage-servicing companies in state and federal court proceedings against claims related to lending and foreclosure practices.

· Representing lenders in collection litigation.

· Defending claims brought pursuant to FCRA and FDCPA.

· Multiple cases defending corporations and boards of directors against shareholder derivative, corporate mismanagement, and breach of fiduciary duty claims.

· Representing investors - both individual and institutional - seeking recovery of assets lost to breach of contract, mismanagement and fraud.

· Representing landlord in landlord/tenant litigation.

Products Liability and Casualty Litigation

Conrad has significant experience defending personal injury and product liability claims. He routinely defends chemical suppliers and manufacturers and electrical utilities and operating companies in litigation involving allegations of defective and dangerous products as well as catastrophic injury and wrongful death. Some of such matters include:

· Defending chemical manufacturer in personal injury claims alleging toxic exposure.

· Defending manufacturer in wrongful death case arising out of operation of industrial machinery.

· Defending homeowners in slip-and-fall litigation.

· Defending electrical utility in wrongful death case occasioned by contact with high-voltage electrical lines.

· Defending manufacturer of automobile passenger compartment in personal injury products liability litigation.

· Defending employer against personal injury claims resulting from automobile collision allegedly caused by employee.

Intellectual Property Litigation

Conrad also regularly litigates intellectual property disputes concerning patents, trademarks and copyrights. Some of his representative matters include:

· Obtaining substantial damages, as well as declaratory and injunctive relief, in trademark and copyright infringement claims on behalf of product marketer-manufacturer.

· Responding to demands and litigation threats by Business Software Alliance against businesses accused of copyright infringement and failure to comply with software licensing requirements.

· Defending individuals and entities in claims brought pursuant to the Computer Fraud and Abuse Act.

· Defending manufacturer of store fixtures against patent and copyright infringement claims brought by national retailer.

· Defending State entity against copyright infringement claims related to theatrical performance by State-sponsored producer.

· Defending magazine publisher against claims related to alleged copyright infringement arising from publication of photographs.

· Pursuing damages and injunctive relief related to false and deceptive trade practices injurious to client corporation.

· Defending departing employees against allegations of theft of proprietary information.

Conrad also provides pro bono assistance to low-income individuals, assisting with divorces, child custody and visitation matters and landlord/tenant disputes. Conrad also volunteers with Better Basics and its Ready-2-Read program, regularly reading to second-graders in Birmingham's inner-city schools.

Outside the office, Conrad spends time with his wife, Alex, and their two dogs, Ashton and Tucker.
