Risk Management for Healthcare Providers
WHAT WE DO
The Medical Malpractice team at CSH recognizes that busy healthcare professionals do not always have a 9 to 5 job, and neither do we. Our experienced attorneys provide legal assistance to healthcare providers 24/7.
We have extensive trial and litigation results across the entire state. Our team helps physicians, hospitals, dentists, nurses, mental health professionals, chiropractors, pharmacists, and other healthcare specialists in a variety of pre-litigation and litigation matters.
We vigorously defend allegations asserted against our clients. We work with experts and our clients to prepare the right trial strategy for the facts and the case. We also recognize when a matter should be resolved early on either through aggressive dispositive motion practice or through negotiations and appropriately counsel our clients on options, risks, and potential outcomes. Results matter.
PROFESSIONAL LICENSING BOARDS
It is stressful and emotional when a patient files a claim against a healthcare provider with the provider’s professional licensing board. All licensing boards investigate allegations and many require a formal response from the healthcare provider. In some instances, a full hearing may be scheduled where the healthcare provider is given the opportunity to put on a defense. Some patients assert claims in conjunction with a lawsuit. The majority of claims are brought without a lawsuit. All claims should be seriously defended due to the possibility of adverse consequences for the healthcare professional.
Our attorneys have successfully defended over 100 of these claims before the North Carolina Medical Board, Dental Board, Nursing Board, Pharmacy Board as well as various mental health provider licensing Boards. No healthcare providers should feel alone during this time. Our attorneys are here to help.
PRE-LITIGATION ADVICE AND RISK MANAGEMENT
Given the extensive trial and litigation experience of our team of seasoned attorneys, we are well-versed in the common pitfalls and areas of potential liability exposure many healthcare professionals are too busy to recognize. We review current protocols, provide staff education and offer risk management training to our clients in a joint effort to improve existing practices and help avoid a claim or a lawsuit.
NON-MEDICAL MATTERS AFFECTING HEALTHCARE PROVIDERS
Whether your hospital is faced with a simple slip and fall case or a workplace violence incident of the highest magnitude, you can be assured that the attorneys at Cranfill Sumner & Hartzog LLP have seen something similar in our practice, and we know how to effectively defend these claims with the intelligent use of discovery and expert witnesses where required.
Whenever an event occurs on your premises, you are facing potential liability for injuries or wrongful death. We are familiar with all the various types of claims you may face and the way attorneys pursue them, including claims for inadequate security and potential liability for the criminal acts of third parties or former employees, an area in which our attorneys have extensive trial experience and valuable relationships with nationally prominent expert witnesses in the field.
