Curtis focuses his practice on litigation and alternative dispute resolution (ADR) both as an advocate and a neutral.
Curtis has experience in many areas of bankruptcy, commercial and civil litigation, including ERISA, construction litigation, consumer law and warranties, commercial collection, real estate and general commercial and business litigation. Curtis also has substantial experience in both prosecuting and defending preference and other avoidance action litigation in bankruptcy courts. In this role, Curtis is called upon to assist regional and national clients in defending against claims throughout the country as well as helping to coordinate such defenses nationwide with the aid of local counsel.
His experience in many substantive legal areas aids in representing clients in the myriad disputes that arise in the context of a chapter 11 bankruptcy. Such experience also helps serve the interests of clients of the firm outside of the bankruptcy context.
He also assists clients in implementing preventative law. Preventative law seeks to help clients avoid or minimize litigation risks or make litigation outcomes more predictable by advance planning including review of contracts and agreements to make them consistent with the client's goals. In addition, such preventative law may help clients utilize alternative dispute resolution procedures (including mediation or arbitration) that may help lessen the overall costs associated with protracted litigation.
Curtis has appeared in and argued cases before all of the courts in Delaware including: Supreme Court, Court of Chancery, Superior Court, Court of Common Pleas, Justice of the Peace Court, United States District Court and the United States Bankruptcy Court as well as courts outside of Delaware.
He is a Certified Mediator for the Delaware Superior Court and is on the panel of mediators for the United States Bankruptcy Court for the District of Delaware.
