A caveat to my response to 1) above: In my one case with Ms. Ducey she did something very unusual and that surprised me which was to object to a settlement going forward between my client and her client where her client was really the insurance company and the insured was represented by independent counsel (so-called Cumis or CHI counsel, based on inherent conflict between insurer and insured where insurer defends under a reservation of rights) and the settlement cost the insured nothing.
