Bruce McCartney's practice focuses on insurance defence litigation, products liability and commercial litigation.
He has extensive expertise in the insurance industry and has a thorough understanding and knowledge of the liability aspects and insurance policies associated with motor vehicle litigation, highway maintenance and design, fire loss, occupier's liability, professional liability and products liability.
His insurance defence litigation practice concentrates, in part, on cases resulting from the design, maintenance and repair of the provincial highways in Ontario. As such, he acts for the insurer of the Province of Ontario in actions that arise under the provisions of the Public Transportation and Highway Improvement Act. In addition he acts for other insurers and companies defending motor vehicle claims and occupier liability claims.
He has a great deal of experience in products liability claims. He acts for a wide range of clients in the retail and manufacturing sector
Mr. McCartney believes that it is important for clients to understand the nature of the case facing them and the various results which may be attained. He strives to provide an overall perspective at the outset of each case, outlining the scope of the action, the investigation that has to be completed and his views on quantum and liability. Where possible he will suggest such cost cutting measures as "alternative dispute resolution", e.g. arbitration, mediation, private court.
He keeps clients informed of the progress of their cases, advising not only of status, but also of events that will have a direct bearing on the outcome of the case. He also counsels on the various strategies that may be employed to ensure that the most favourable outcome is attained. At all times, he maintains the objectivity that is necessary to advise clients on the merits of proceeding or settling at each stage of the litigation process.
His experience and ability to distil information quickly and effectively enable him to communicate a complex problem with clarity and to represent clients effectively before the Courts.
