Daniel represents clients in the energy industry with a focus on regulation and competition issues. His energy practice includes the representation of electric utilities, natural gas pipelines, and transmission companies in proceedings before the Federal Energy Regulatory Commission (FERC) and various state public utility commissions, particularly in matters related to administrative complaints and litigation, merger proceedings, ratemaking and certificate proceedings, and investigation and compliance matters.
Representative Experience
Counseled a southeast natural gas pipeline company and an affiliated local distribution company in FERC natural gas pipeline rate cases.
Counseled a natural gas pipeline in an internal investigation resulting in a self-report to FERC Enforcement Staff.
Represented utilities in Bonneville Power Administration wholesale power and transmission rate cases.
Counseled limited jurisdiction (Hinshaw and Section 311) storage and pipeline companies on FERC regulatory compliance matters, including compliance with FERC Form No. 549D.
Counseled local distribution companies in matters pertaining to FERC regulation, including Section 7(f) of the Natural Gas Act and limited jurisdiction blanket certificate applications, and related Stipulation and Consent Agreement to resolve all rate-related issues.
Assisted coalition of interconnection and transmission customers in drafting and filing a complaint and petition for order under Section 211A of the Federal Power Act against a federal power marketing agency.
Counseled association of U.S. Shareholder-Owned Electric Companies on various disclosure and accounting issues at the U.S. Securities and Exchange Commission.
Counseled investor-owned utilities on generator and transmission interconnections.
Advised electric utility on North American Electric Reliability Corporation Standards.
Prepared Order No. 890 compliance filings for investor-owned utilities.
Advised gas pipeline on precedent agreements and related materials for pipeline expansion project.
Drafted standards of conduct implementation procedures for natural gas pipeline.
