Biography

Experience

Daniel J. Cogan is a partner in the firm and is an AV Preeminent-rated attorney by the Martindale-Hubbell Peer Review Rating® system. Dan is the Co-Chair of the Construction Defect practice group where he specializes in the defense of architects and engineers as well as contractors. He has litigated claims on behalf of design professionals in the Superior Court of New Jersey and in matters before the American Arbitration Association, and has argued on behalf of design professionals before the New Jersey Supreme Court. He also has extensive experience mediating complex construction matters to successful resolution. In addition to his litigation practice, Dan also assists professional clients in contract preparation and review on all manner of construction projects, and has presented seminars to the design professional community on the use of AIA form contracts.

Recently, Dan successfully defended his architect client on an appeal before the New Jersey Supreme Court in the matter of Daidone v. Buterick Bulkheading, 191 N.J. 557 (2007). The Daidone decision set a bright-line rule for the commencement of the 10-year period during which design professionals and contractors can be sued under the New Jersey Statute of Repose. Dan was also co-counsel in a matter before the New Jersey Supreme Court, Greczyn v. Colgate Palmolive, 183 N.J. 5 (2005), which clarified the standards for the use of fictitious party practice in connection with a complaint filed against a design professional outside of the ten-year Statute of Repose. He also was involved in the briefing in several leading appellate decisions related to construction law, including Carvalho v. Toll Brothers, 143 N.J. 565 (1996), a landmark decision in the area of construction site safety; and Kane v. Hartz Mountain Industries, 278 N.J. Super. 129 (App.Div.1994), aff'd. 143 N.J. 141 (1995), a leading decision interpreting the evidential impact of OSHA violations.
