Daniel Boglioli is Counsel in the firm's Litigation Department and has broad experience in all phases of litigation. He has extensive experience in patent litigation, counseling on intellectual property issues and general commercial disputes. His intellectual property experience includes litigation, licensing and opinion work regarding patents in biotechnology, pharmaceuticals, telecommunications, lighting control devices, and coal and natural gas technology. He has also taken a lead role in several real estate litigations and transactional matters. Patent Litigation Experience Mr. Boglioli represented Pfizer Inc. in a patent infringement suit brought by the University of Rochester involving Celebrex®, a drug for the treatment of arthritis and other disorders. The case resulted in a victory for Pfizer with a decision by the Federal Circuit upholding the district court's decision invalidating the patent-in-suit on a motion for summary judgment. In 2006, Mr. Boglioli also represented Pfizer in a patent infringement suit against Teva Pharmaceuticals USA, Inc., based on Teva's attempt to seek FDA approval for a generic version of Celebrex®. After a four-week trial, the district court found the patents valid, infringed and enforceable. Also In 2006, Mr. Boglioli participated in thee separate trials of Pfizer's patent protecting the drug Norvasc®, the most-prescribed brand-name high blood pressure medicine worldwide. Three different district courts all found the patent valid, infringed and enforceable after trial, but subsequently, the Federal Circuit reversed the decision in Pfizer v. Apotex, holding the patented invention was obvious. In 2007, Mr. Boglioli represented Lutron Electronics, Inc. in an ITC investigation and U.S. District Court action on claims that the defendants infringed seven patents, as well as copyrights and trademarks, relating to lighting control devices owned by Lutron. Mr. Boglioli has also represented clients in telecommunications patent litigations involving aspects of broadband data and video transmission, coaxial cable and data transmission, headends, data centers, satellite communication, and handheld computing. Real Estate Litigation Experience Mr. Boglioli has been involved in several litigations and acted as de facto General Counsel for two companies, handling all litigation matters and negotiating commerical leases. Pro Bono Mr. Boglioli chairs the firm's Social Security Income Disability (SSI), Post-Release Supervision (PRS) and Uncontested Divorce (UD) sections of Kaye Scholer's Pro Bono Committee. He personally represents clients and staffs and supervises dozens of SSI, PRS and UD cases. In 2007, Kaye Scholer received The Legal Aid Society's Pro Bono Award for its outstanding service on SSI cases. In 2008, the Legal Aid Society honored Mr. Boglioli for his extensive work on PRS cases. Also in 2008, Sanctuary for Families honored Mr. Boglioli with their highest individual award for his work on UD cases. Publications Mr. Boglioli was a co-author for several years of "Large-Firm Life," a regular column in the New York Law Journal, in which he wrote on general matters related to associate life in a large New York firm.
