Biography

Daniel M. Flores is an associate in the Los Angeles Area office of Gibson, Dunn & Crutcher. He is a member of the Litigation Department, practicing primarily in the firm's Antitrust and Trade Regulation, Intellectual Property, and Media, Entertainment, and Technology practice groups. Mr. Flores has litigated antitrust and unfair competition matters and counseled clients regarding competitive business practices in the entertainment, automotive, airline, chemicals, energy, health care, insurance, jewelry, software, and technology industries. Mr. Flores has also litigated numerous matters involving copyright, trademark, patent, false advertising, business tort, and contractual issues on behalf of clients in the film, television, music, publishing, and video game industries. Mr. Flores has appeared before federal and state trial and appellate courts across the United States and before the U.S. Trademark Trial and Appeal Board. He is a member of Gibson, Dunn & Crutcher's Diversity Committee.

Representative cases include:

ˇ Representation of a medical device company asserting claims of trade secret misappropriation, breach of contract, and interference with prospective economic advantage. Mr. Flores was instrumental in successfully opposing summary judgment and was the second chair lawyer in a two-week federal jury trial in the Central District of California.

ˇ Representation of a broadcast television network as the second chair lawyer in a 10-day arbitration involving a profit participation dispute brought by a major television studio, resulting in an arbitration award that completely vindicated the client's rights and obligations.

ˇ Representation of Nissan North America, Inc., Nissan Canada Inc., and Nissan Motor Ltd. in antitrust consumer class actions alleging violations of federal and state antitrust and unfair competition laws brought in numerous federal and state courts around the country. Mr. Flores was instrumental in obtaining dismissals of Nissan Canada Inc. and Nissan Motor Ltd. for lack of personal jurisdiction and obtaining summary judgment for Nissan North America, Inc. in the consolidated federal MDL action.

ˇ Representation of Nissan North America, Inc. and Nissan Motor Ltd. in obtaining summary judgment on conspiracy, monopolization, tying, and unfair competition counterclaims on behalf of Nissan in trademark and false advertising litigation against importers of gray market Nissan automobile parts.

ˇ Representation of Warner Music Group in defending against antitrust and business tort claims brought by two independent record labels, obtaining dismissal of three amended complaints asserting claims of intentional interference with prospective economic advantage and the eventual settlement of all antitrust claims against WMG.

ˇ Representation of Sony BMG Music Entertainment in litigation brought by an independent record label alleging federal copyright, trademark, false advertising, and unfair competition claims, obtaining a favorable settlement and dismissal of all claims against Sony BMG.

ˇ Representation of nine major video game publishers in patent infringement litigation brought in the Eastern District of Texas, obtaining a complete dismissal of all claims.

ˇ Representation of Penguin Group (USA) Inc. and a bestselling author in securing an extraordinarily favorable settlement of litigation involving claims and counterclaims alleging copyright infringement, false advertising, trademark infringement and dilution, cyber-piracy, and unfair business practices.

Mr. Flores has contributed to the following publications: Antitrust and Unfair Competition Law Section, The State Bar of California, California Antitrust and Unfair Competition Law (Matthew Bender & Co., 4th ed., 2009); Antitrust Laws and Trade Regulation (Matthew Bender & Co., 2d ed.); Antitrust Adviser (West, 4th ed.).

Mr. Flores received a J.D. degree in 2002 from Columbia University School of Law, where he was a Harlan Fiske Stone Scholar, an Articles Editor for the Columbia Business Law Review, and a Moot Court Editor. He graduated summa cum laude with a B.A. in Music from the University of Nevada Las Vegas in 1999, and was awarded the Nevada Centennial Medallion as the highest-ranked undergraduate.

Mr. Flores is admitted to practice law in California and Nevada and before the United States District Courts for the Central, Northern, and Southern Districts of California and the District of Nevada. He currently serves as the Secretary/Treasurer of the Antitrust and Unfair Business Practices Section of the Los Angeles County Bar Association. Mr. Flores is also a member of the antitrust sections of the American Bar Association and the California State Bar and he is a member of the Association of Business Trial Lawyers.
