Daniel N. Burton is a retired partner of Foley & Lardner LLP. A former chair of the firm's Florida Health Law Practice, he was a member of the Health Law Department (Payments/Compliance Practice). Mr. Burton represented hospitals and physician groups both as general counsel and as a litigator. In particular, he has extensive experience representing hospitals, physicians and other health care providers in general health law matters with particular emphasis in licensing, regulatory, credentialing and compliance issues including health care related litigation.
In practice for more than 30 years, Mr. Burton is thoroughly familiar with hospital operations, physician practice problems, ethics and life termination questions, Medicare fraud and abuse, inurement issues, general risk management and medical staff matters.
A respected author and speaker in the health care field, Mr. Burton has lectured at professional seminars, universities and law schools on professional liability, risk management, licensure and other regulatory matters. He once presented in a session of "Grand Rounds" at the University of Cincinnati Medical School.
He also represented both health care and general business clients in commercial litigation involving issues such as institutional or product liability, regulatory compliance (for example, relating to a hospital client's use of a biohazardous waste incinerator) and insurance disputes.
A fellow of the prestigious American College of Trial Lawyers, Mr. Burton is also a member of the American Health Lawyers Association and the Florida Academy of the Florida Hospital Association. He is listed in both the health law and litigation sections of The Best Lawyers in America. He is certified by the Florida Bar as a specialist in both health law and as a civil trial attorney.
Mr. Burton has long been active in the Florida Bar Association, in both the Health Law Section and the Trial Lawyers Section, of which he was section chairman (1981), member of the Executive Council (1977), chairman of the Civil Trial Certification Committee (1982), chairman of the Health Certification Committee, and member of the Board of Legal Specialization and Education (1988 to Present).
Mr. Burton is a graduate of Stetson Law School (J.D., 1964), where he was Phi Alpha Delta, and Rollins College. Mr. Burton was admitted to the Florida Bar in 1964 and is also admitted to practice before the United States Supreme Court.
