Mr. Nix is a partner in the Atlanta office of Kutak Rock LLP and a member of the Derivatives and Structured Finance Practice Groups. His practice is concentrated in the areas of secured lending and structured finance, including real estate-secured swaps and derivatives. Mr. Nix also has extensive experience representing institutional lenders and investment banks in connection with the purchase of and provision of credit enhancement for tax-exempt bonds.
Mr. Nix has participated in many novel financing techniques including the financing of alternative energy projects and the provision of guaranteed returns for investors in LIHTC partnerships under standard ISDA documentation.
•Lead counsel to a national investment bank in connection with the restructuring of various tax credit portfolios for two major tax credit syndicators.
•Counsel to institution guarantying tax credit portfolio with respect to workout of underlying property level financings.
•Lead counsel to a national investment bank in connection with the workout and restructuring of numerous real estate-secured total return swaps.
•Underwriter's counsel in connection with the issuance of over $500 million of preferred equity interests in partnerships owning tax-exempt bonds.
•Counsel to a national financial institution in connection with its purchase of more the $1 billion in tax-exempt bonds secured by multifamily and commercial projects.
•Lead counsel to a national investment bank in connection with in excess of $100 million of bridge financing for 15 alternative energy projects under standard International Swaps and Derivatives Association (ISDA) documentation.
•Lead counsel to a national investment bank providing guaranteed returns for tax credit syndications under standard ISDA documentation.
