Biography

David Conway is an associate in Venable's Intellectual Property Litigation Practice Group. Mr. Conway's practice involves assisting clients on a variety of issues, focusing especially on trademark, unfair competition, federal and state advertising laws, and right of publicity.

While earning his law degree, Mr. Conway served as judicial intern to the Honorable Diane S. Sykes, Seventh Circuit Court of Appeals, and the Honorable Charles N. Clevert, United States District Court, Eastern District of Wisconsin.

Representative Experience

Mr. Conway's litigation experience includes:

· Filing an amicus brief in the United States Supreme Court on behalf of former U.S. Senator Birch Bayh. Mr. Conway played a significant role in drafting and editing the brief, which was filed in support of the Bayh-Dole Act, the statute that forms the basis for the modern university technology transfer system.

· Defending a trade association against claims seeking cancellation of the client's trademark. Mr. Conway helped secure dismissal of the case on jurisdictional grounds.

· Representing an international media and marketing company in its effort to prevent the misuse of its trademarks on the internet. Mr. Conway helped secure a preliminary injunction prohibiting a competitor from using the client's trademarks as search engine keywords to draw consumers to websites containing false statements about the client's products.

Activities

Mr. Conway is a Young Lawyer Representative for the American Bar Association's Section of Antitrust Law, Private Advertising Litigation Committee. He is also a weekly contributor to Private Advertising Litigation Updates, an ABA newsletter that reports on advertising, marketing, and consumer litigation case law developments.

On a pro bono basis, Mr. Conway has successfully represented clients before the Social Security Administration's Office of Disability Adjudication and Review.
