David Mayberry is a counsel in Crowell & Moring's Anchorage office. He represents large and small clients to solve legal issues and achieve business objectives. Mr. Mayberry's practice focuses on the energy and natural resource industries, particularly in securing workable state and federal environmental authorizations and defending those permits when challenged in administrative or judicial forums. Mr. Mayberry provides legal representation and governmental affairs services for clients that include fully-integrated and independent oil and gas companies, natural gas pipelines, public utilities, and energy companies. He represents clients before state and federal regulatory agencies, and state and federal courts.
Mr. Mayberry has substantial litigation experience in complex environmental cases arising under federal and state environmental laws, including NEPA, the Endangered Species Act, the Safe Drinking Water Act, the Oil Pollution Act, the Coastal Zone Management Act, the Alaska Land Act, and the common law. He negotiates and defends civil enforcement actions on behalf of industrial clients and provides regulatory compliance counseling under various federal and state laws.
Mr. Mayberry also provides legal advice and representation to industry clients on a wide range of business matters, including entity organization and formation, contracts, alternative dispute resolution, and commercial litigation. In the oil and gas sector, Mr. Mayberry advises clients on issues regarding unit agreements, operating agreements, drilling and other services contracts, unit and participating area formation, and lease sales.
Before joining Crowell & Moring, Mr. Mayberry was an attorney in the Anchorage office of a major Washington, D.C.-based law firm. Mr. Mayberry also served as a law clerk for the Hon. James K. Singleton, Jr. in the U.S. District Court for the District of Alaska.
Representative Matters:
· Represented oil and gas client in case permitting major offshore arctic Alaska oil exploration project and successful defense of four separate legal challenges to project initiated in the 9th Circuit, U.S. District Court, Interior Board of Land Appeals and Alaska Superior Court.
· Cook Inlet Keeper v. State of Alaska: Successful representation of oil and gas client in repeated environmental group challenges to offshore oil exploration and development project.
· In the Matter of the Tariff Revision Designated as TA226-8 filed by Chugach Electric Association, Inc.: Represented wholesale electric power purchaser in successful challenge to application for substantial rate increase filed by power generator.
· Lead counsel for oil and gas client in private commercial arbitration, successfully defending against multi-million dollar claim.
