Biography

David Malach is a member of the Tax Group and Co-Chair of the Tax Litigation Team. David was Managing Partner from 2002 to 2006, and is currently a member of the firm's Executive Committee.

Practice

David practises in the areas of tax, including tax litigation, corporate reorganizations and estate planning. David's tax litigation practice includes acting for taxpayers at all levels of the tax litigation process.

He acts for corporations and individuals at the audit stage, negotiates with the Canada Revenue Agency, makes representations at the Notice of Objection or Appeals level and appears for clients at the Tax Court of Canada, Federal Court of Appeal and the Supreme Court of Canada. David's corporate tax practice includes both domestic and international tax planning for clients ranging from large multinational public corporations to small privately owned Canadian corporations.

He advises on general tax planning, drafting disclosure for public documents, structuring and implementing corporate reorganizations, structuring cross-border acquisitions and divestitures and assisting in moving Canadian businesses offshore to tax havens to reduce Canadian tax.

David's personal tax planning practice includes tax and estate planning for high net worth individuals, planning to reduce taxes through income splitting, planning for immigrating and emigrating individuals, creating offshore creditor-proofing trusts for clients in financial difficulty and tax planning for employees and owner-managers.
