David focuses his practice in the area of litigation, with an emphasis on product liability, construction and employment litigation. David represents product designers and manufacturers in litigations involving a broad range of issues. David also represents and counsels employers on a variety of employment issues, including employment terminations, sexual harassment and employment discrimination. David practices in both federal and state court, as well as before administrative agencies. He is also a member of the Firm's Pro Bono Committee.
Notable Experience
· David serves as national coordinating counsel for a global manufacturer's product liability cases.
· David argued the cases of Marrone v. Greer & Polman Construction, Inc., et al., 405 N.J. Super. 288 (App. Div. 2009) and Dean v. Barrett Homes, Inc., 406 N.J. Super. 453 (App. Div. 2009), rev'd on other grounds, 204 N.J. 286 (2010), in which he convinced New Jersey's Appellate Division to extend the economic loss doctrine to bar tort claims against the manufacturer of a component part that was alleged to not only injure itself, but to cause damage to the integrated product of which it was a part.
· On behalf of a worldwide car rental chain, David has won summary judgment dismissals of whistleblower and sexual harassment cases in both federal and state court.
· On behalf of a global food service company, David obtained summary judgment dismissals of race, national origin and sexual harassment cases.
· David successfully mediates/resolves employment claims before the EEOC.
