Biography

David focuses on complex commercial litigation as a member of Husch Blackwell's Energy & Natural Resources industry team. David uses his litigation expertise to handle complex disputes within federal and state courts around the country. Additionally, he represents parties in appeals, arbitrations and mediations. He also has served as an arbitrator in more than 30 disputes.

David's accomplishments include:

•Representing claimant in a dispute concerning various agreements with former co-venturers with respect to an oil and gas project in Belize and Guatemala. Obtained a money judgment against the respondents and defeated all counterclaims.

Obtaining a judgment of more than $2 million in Texas federal court in a dispute involving a Wyoming oil and gas exploration agreement for oil and gas acreage. Judgment affirmed on appeal

Representing the officers and directors of a natural gas exploration and development company sued by a dissenting shareholder in a variety of claims alleging breach of fiduciary duty and tort claims, resulting in a landmark ruling.

Representing a defendant in a case involving derivative and class claims concerning a merger in South Carolina state court.

David has additional experience with litigation involving banking, contracts, real estate, construction, business torts and healthcare.

David joined the firm as a Partner in 2008 from Holme Roberts & Owen, where he practiced for nearly 30 years. He has taught courses at the University of Colorado School of Law, including legal writing and appellate advocacy.

Experience

Obtained a money judgment against respondents and defeated all counterclaims in a dispute concerning various agreements with former co-venturers. This involved oil and gas projects in Belize and Guatemala.

•Counseled client in a dispute involving an oil and gas exploration agreement for acreage in Wyoming. Obtained $1.5 million in accrued interest and attorneys' fees.

•Represented the officers and directors of a natural gas exploration and development company. The company was sued by a dissenting shareholder in a variety of claims alleging breach of fiduciary duty and tort claims. This case resulted in a landmark ruling.

•Obtained landmark ruling from Colorado Supreme Court construing the state's Dissenter's Rights Act barring claims against directors and officers of a company by a shareholder exercising his rights as a dissenting shareholder under the act.

•Obtained favorable ruling on behalf of mining company from the U.S. Court of Appeals, Tenth Circuit, in 2006 construing the Mining Law of 1872, affirming ruling that denial of mining patent is not subject to judicial challenge.

•Represented dental practice management firm in extensive federal court litigation in New Orleans, La.
