David W. Simon is a partner with Foley & Lardner LLP and a member of the White Collar Defense; Corporate Compliance & Enforcement; Securities Enforcement & Litigation; and Antitrust Practices. He currently serves as the vice chair for strategic development of the firm's Litigation Department. Mr. Simon, a litigator with substantial experience conducting internal investigations and representing corporate clients in state and federal courts, devotes much of his practice to helping corporate clients manage crises that potentially give rise to government enforcement actions. He has represented companies faced with a variety of substantive legal issues, including potential violations of the antitrust laws, the Foreign Corrupt Practices Act, the False Claims Act, and various other criminal laws. Significant representative matters in recent years include conducting a 10-country investigation into potential SEC rules violations by affiliates of a professional services firm, participating in a global corruption compliance review for a large multi-national corporation, representing the Commissioner of Major League Baseball in connection with Senator George Mitchell's investigation into the use of steroids and other illegal performance enhancing drugs in baseball, and serving as lead counsel for a client facing Foreign Corrupt Practices Act issues arising out of the company's business practices in China. Mr. Simon graduated with honors from the University of Wisconsin - Madison (B.A., 1989), and from the University of California - Berkeley, Boalt Hall School of Law (J.D., 1994), where he was elected to the Order of the Coif and was a member of the California Law Review. He joined the firm after a judicial clerkship with the Honorable Robert W. Warren, U.S. District Court for the Eastern District of Wisconsin.
