Dean T. Barnhard practices in the firm's Litigation and Intellectual Property Departments. Mr. Barnhard has a national practice representing a Fortune 50 chemical manufacturer in the defense of toxic tort and product liability claims and is a frequent speaker on issues relating to effective discovery techniques and motion practice in the defense of chemical manufacturers. Mr. Barnhard has defended product-related mass tort and environmental contamination cases in Hawai'i; mass tort, putative class action and RICO claims in New York; and cases of like kind, including individual personal injury and crop loss cases, across the United States. As counsel to CMG Worldwide, an international sports and entertainment licensing and business agency, Mr. Barnhard has represented the families and estates of numerous celebrities such as James Dean, Marilyn Monroe, Humphrey Bogart, and Babe Ruth. He has also represented legendary NASCAR champion Bill Elliott. Mr. Barnhard has successfully pursued infringements of celebrity rights nationally and internationally, including infringements in England, Japan, Spain and Australia. Mr. Barnhard tried the first televised federal court trial in an action in New York involving James Dean's rights of publicity and helped successfully defend the James Dean Foundation Trust and others in a $90 million suit in Los Angeles brought by Warner Bros. over the merchandising rights to James Dean's persona, securing an award of defense costs, including attorneys' fees, in excess of $1.6 million. He is a member of the bar of the United States Supreme Court, the Indiana Supreme Court, and the Courts of Appeal for 11 Federal Circuits. He is also a member of the Defense Research Institute, Defense Trial Counsel of Indiana, the American Bar Association, the Seventh Circuit Bar Association, the Indiana State Bar Association and the Indianapolis Bar Association. Mr. Barnhard earned his J.D. cum laude from the Indiana University School of Law-Indianapolis in 1983. Mr. Barnhard was listed in the 2011 and 2012 editions of The Best Lawyers in America® in the area of product liability litigation, has been selected for inclusion in several editions of Indiana Super Lawyer® magazine, and is rated "AV Preeminent" by the Martindale-Hubbell Law Directory, its highest rating. Prior to entering the law, he was a professional tuba player and taught at the University of Miami in Coral Gables, Fla., where he received his B.M. and M.M. in music.
