Ms. Nye is a partner with the national law firm of Kutak Rock, LLP, working out of their Fayetteville and Little Rock, Arkansas offices. Her legal practice is focused upon health care-related corporate and regulatory matters, representing health care providers with issues involving their general operational health care practice activities and their continued compliant participation in the Medicare and Medicaid Programs. Ms. Nye presents matters before the health providers' regulatory agencies, boards and commissions. She addresses licensure, survey and reimbursement regulatory matters, certificate of need or permit of approval issues and conducts governmental relations activities.
Ms. Nye served as General Counsel for the Arkansas Health Care Association from 1997 to 2005, and from September 1984 until August 1995 served as Chief Counsel and Executive Manager of the Office of Chief Counsel, Arkansas Department of Health & Human Services. As Chief Counsel, she managed fraud investigations, appeals and hearings, risk management and 35 attorneys supporting all Human Services programs and services. She principally represented the Arkansas Medicaid Program.

The Affordable Care Act (ACA), enacted in 2010, mandates that Medicare/Medicaid-certified nursing facilities and skilled nursing facilities have an effective compliance plan in place by March 23, 2013. ACA states that [by March 23, 2013], a facility shall ? have in operation a compliance and ethics program that is effective in preventing and detecting criminal, civil, and administrative violations ? and in promoting quality of care.
