Practice/Industry Group Overview
The Family Law Practice Group of Dinsmore & Shohl LLP represents individuals in divorce, dissolution, legal separation, annulment actions, paternity actions, child support actions and in civil domestic violence cases. We also provide continuing assistance to clients after the divorce to address modification or enforcement of court orders regarding custody, support and division of property. Dinsmore & Shohl LLP also provides sophisticated premarital and post-marital planning for termination of a marriage whether by death or divorce. This generally means prenuptial agreements, post-nuptial agreements (where allowed) and other estate planning. By well executed planning, the client can control the division and distribution of property and payment of support in the event of death or divorce, rather than simply submit to the laws of the state where the client happens to reside when the marriage ends.
In the divorce process, our attorneys guide clients through the development of plans and agreements for the division of property, payment of support and custody of children. In the formulation of parenting plans and property/support agreements, our attorneys work with medical personnel, accountants, financial planners and valuation experts to ensure that the client is appropriately advised of meaning and effect, including tax impact, of any proposed resolution of the matrimonial law issue at hand.
Our attorneys also assist clients when using the services of a mediator to aid in reaching agreement on family law matters. We are also trained in collaborative law for clients who wish to use the collaborative process to reach agreement and dissolve their marriage.
While we focus on resolution of disputes without unnecessary litigation, where a private settlement is not possible or appropriate, our attorneys are experienced in litigating divorce and dissolution issues.
