Biography

Attorney/scientist Henry Daley focuses on maximizing the value of the IP portfolios of his clients.

Dr. Daley counsels a wide range of technology companies-from early-stage startups to multinational corporations to universities and research organizations.

He develops and manages patent portfolios based on many technologies, including semiconductors, nanotechnology, energy production, photonics, optical devices, imaging systems and medical devices, among others.

Dr. Daley often conducts patent-clearance studies for proposed new products and advises on approaches to designing around a competitor's patents to avoid infringement. He also provides non-infringement and/or invalidity opinions with respect to competitors' patents.

Dr. Daley counsels clients with strategies to avoid and/or prepare for litigation, whether defending against claims of patent infringement or seeking enforcement of IP rights.

Science Experience

Dr. Daley conducted research at Daresbury Laboratory in England involving Daresbury's heavy-ion accelerator and synchrotron radiation source as well as its supercomputer facilities.

He collaborated with physicists at the Universities of Oxford; Saclay, France (conducting electron-scattering experiments); Yale University (The Wright Nuclear Structure Laboratory); and Milan, Italy (conducting heavy ion-scattering experiments).

After returning to the United States, Dr. Daley was a research scientist at Massachusetts Institute of Technology, Lincoln Laboratory, where he managed research on projects funded by the Department of Defense, Defense Advanced Research Projects Agency, Federal Aviation Administration and NASA. His research included technology related to a vast range of sensors and systems, including radar systems, radio frequency, infrared and optical-detection systems, avionics and signal-processing algorithms and techniques.

Dr. Daley also taught a wide range of physics courses, including advanced laboratory courses for upper-level undergraduates and first- and second-year graduate students. He was responsible for advanced laboratory courses with a professor who was nominated for the Nobel Prize for the discovery of buckminsterfullerene, which played an important role in igniting interest in nanotechnology.

Earlier, as an undergraduate, he was responsible for the operation of Worcester Polytechnic Institute's laser-physics laboratory, where he conducted experiments involving scattering laser light from dispersions of submicron spherical particles. His research also involved developing techniques to prepare dispersions of nanoparticles.

Representative Clients

He has advised the world's largest producer of photolithography systems, the largest maker of endoscopes and microscopes, and one of the largest camera and imaging companies, as well as startup companies in technologies such as:

· photonics components

· nano-electronic devices

· lasers

· nanomaterials and nanosystems

· lab-on-a-chip devices

· optical communications systems

· micro-electromechanical systems (MEMS)

· wireless systems.

Significant Matters

Dr. Daley is developing patent portfolios for "clean technology," including advances in photovoltaic technology, batteries, super capacitors, energy scavenging and recuperation technology and a novel energy-production system in a completely new energy sector.

He is developing patent portfolios related to next-generation radio-frequency identification (RFID) technology and its applications, including to the medical field.

He conducts pre-litigation infringement analysis, proposes development strategies, performs IP audits and negotiates IP licenses.

Dr. Daley has extensive experience with high-stakes litigation involving physics, optics, electrical engineering and precision electro-mechanical systems.

He has handled cases before several federal district courts, the International Trade Commission and the U.S. Court of Federal Claims involving lasers, photolithography systems, medical devices, optical communications systems and avionics systems.

Activities

Dr. Daley was a member of the Nanotechnology Committee of the Intellectual Property Owners Association in 2005 and on the Nanotechnology Advisory Committee providing advice to the Commonwealth of Virginia through the Joint Commission on Technology and Science in 2005 and 2006.

He is also active with the nanotechnology committee of the Northern Virginia Technology Council and works extensively with inventors at the California Nano Systems Institute.
