Biography

Dwight D. Lueck is a partner in the Indianapolis, Indiana office of Barnes & Thornburg LLP, where he is a member of the firm's Intellectual Property Department. He has been selected for inclusion in The Best Lawyers in America® 2010 in the field of intellectual property.

Mr. Lueck concentrates his practice on counseling clients on the many legal issues surrounding the marketing of products and services and litigating cases. He has litigated numerous cases concerning infringement of trademarks, trade dress, domain names, copyrights, and patents. The subject matter of these cases has ranged from computer software and ultrasonic material level measurement systems to ceiling fans and athletic shoes. Mr. Lueck has also litigated cases alleging violations of the antitrust laws, franchise laws, unfair competition, improper termination of distributors and sales representatives, and violation of non-competition agreements and trade secret agreements.

As part of his counseling practice, Mr. Lueck has advised clients on a wide variety of U.S. and international trademark matters, including clearance opinions on the ability to use a mark, prosecution of trademark applications, litigation to enforce trademark rights, and litigation to protect domain name rights. Mr. Lueck has made a number of presentations concerning protection of trademark and domain name rights and enforcement of covenants not to compete. He has also advised clients on establishing dealership networks and drafted the dealership agreements used with those networks.

Mr. Lueck graduated cum laude from Carleton College in 1984 and received a J.D. cum laude from the University of Minnesota in 1988. He joined Barnes & Thornburg in 1988. He is admitted to practice in Indiana and in the 3rd, 7th, and Federal Circuits.
