The service plaza overhauls will also include "green" initiatives to bring the facilities up to Leadership in Energy and Environmental Design standards, improve water runoff patterns, and install idle-reduction technology for use by trucks on the Connecticut Turnpike, also known as Interstate 95. Including projected revenues, initial construction, and reinvestments, the benefit to the State of Connecticut is estimated to be almost $500 million over the term of the agreement. - Represented Boulder County, Colorado, in defense of a claim under the federal Religious Land Use and Institutionalized Persons Act (RLUIPA) in federal district court. This jury trial involved complex federal and local issues of religious rights under the U.S. Constitution and RLUIPA, as well as the interests in Boulder County, in furthering the objectives of its comprehensive plan and consistent land use regulations. The principal issue, of national importance, was whether a megachurch can double in size to more than 200,000 square feet in contravention of local planning and regulations. Robinson & Cole won jury verdicts on multiple federal and state constitutional claims and one claim brought under RLUIPA. While the jury found for the church on three RLUIPA claims, the jury awarded no damages. The 10th Circuit upheld the jury verdict. - Representation of a real estate investment trust company in the New York City metropolitan area in an eminent domain proceeding versus the State of New York. Court awarded client approximately $100 million in damages. - Served as special counsel under the direction of the New Jersey Attorney General's office to the New Jersey Meadowlands Commission (formerly known as the Hackensack Meadowlands Development Commission), an agency of the State of New Jersey which owns, or will acquire, an area in excess of 1,000 acres. Appellate - Represented owner of a rare, undeveloped, peninsular building lot on Long Island Sound in an administrative appeal from the town's denial of zoning permit. Persuaded the trial court to reverse the town's denial and to order the town to grant all permits necessary to construct our client's home on the property. Successfully defended the judgment before the Connecticut Appellate Court and defeated a petition for certification to the Connecticut Supreme Court. Real Estate - Defended a national railroad company against inverse condemnation and trespass claims concerning an alleged easement over the railroad. This case involved complicated valuation issues related to the presence of mineable stone and rock on the property and the feasibility of developing an industrial subdivision on property that was purportedly landlocked by the alleged taking.
