The Intellectual Property Group at Edwards Wildman Palmer LLP has developed extensive experience over many years in establishing, managing, asserting and defending intellectual property rights. The firm represents the interests of its foreign clients in American courts and before U.S. government agencies, providing services performed by agents, solicitors, and barristers in other judicial systems. We have more than 80 intellectual property patent attorneys and agents, of whom 16 have doctorate degrees and an additional 12 have masters degrees in areas of science and engineering. Trademarks, Service Marks, Trade Dress, Internet Domain Name and Copyrights

Edwards Angell Palmer & Dodge provides its clients with legal advice and opinions concerning the adoption and use of trademarks, service marks, trade names, and domain names, and the licensing of these valuable properties.

Our attorneys prepare, file and prosecute U.S. trademark and service mark applications on behalf of our clients, including intent-to-use and regular use-based applications. We are consistently ranked by Intellectual Property Today in the top one hundred of nation-wide law firms in terms of the number of U.S. trademark registrations issued to its clients. Our firm works with a worldwide network of foreign associates to serve all of the foreign trademark registration needs of our clients.

Our trademark practice also includes trademark litigation. In addition, we are called upon to protect our clients' rights by means other than litigation, e.g., through licensing, purchasing of competing marks, and similar services.

Our firm also has extensive experience in trademark administrative proceedings conducted within the Unites States Patent and Trademark Office, namely opposition and cancellation proceedings.

We counsel our clients regarding alternative types of trademark-like protection available under both federal and state law. For example, trade dress protection, namely, the protection of the appearance of our clients' products and packaging, is often a significant asset. In addition, we consult with corporate legal departments on ways to effectively administer and maintain trademark operations in-house. Our mission is to ensure that our clients receive the fullest return possible on any investment in their commercial properties.

Edwards Angell Palmer & Dodge has been progressive and aggressive in pursuing protection for our clients in cyberspace. Our practitioners help our clients to choose, register and protect internet domain names. We also counsel our clients on the proper use of their domain names, as a part of a comprehensive trademark strategy, to maximize their protection. In addition, we represent parties involved in controversies concerning domain names and the application of intellectual property laws to cyberspace.

Our attorneys also counsel authors and artists and represent them during licensing and contractual negotiations, as well as in litigation. Our goal is to provide the highest quality representation to our clients to protect their creations. Edwards Angell Palmer & Dodge attorneys have the experience to guide our clients through the often confusing legal web of copyright and contract law.

Licensing, Collaborations, Joint Ventures, Strategic Alliances

We structure and negotiate a large number of corporate collaborations, joint ventures and other forms of strategic partnerships involving intellectual property, as well as innovative off-balance sheet research and development financings in the biomedical, software, and electronics industries.

Edwards Angell Palmer & Dodge also provides assistance to our clients in performance of due diligence assessments on intellectual property aspects of mergers, acquisitions and divestitures, negotiating protection in the agreements, and transferring title and rights to such property.
