Biography

Elder C. Marques is an associate in our Litigation Group in Toronto. He conducts a wide-ranging litigation practice that includes complex corporate and commercial disputes, class actions, and professional liability cases.

Mr. Marques has considerable experience before judges, juries, and administrative boards and tribunals on behalf of individuals and corporations. He regularly represents physicians before the courts and various regulatory bodies. He also represents both plaintiffs and defendants in defamation actions.

Mr. Marques co-authored the chapter on Canadian cross-border class actions in the 2012 edition of the American Bar Association's Annual Review of Developments in Business and Corporate Litigation. He is also a regular contributor to McCarthy Tétrault's Canadian Appeals Monitor.

Mr. Marques' notable recent cases include the following:

· Counsel to a dissident group engaged in a proxy contest in respect of procedural relief relating to the distribution of proxy materials (Laumann v. Economical Mutual Insurance Co., 2011 ONSC 2653, 98 C.C.L.I. (4th) 74, [2011] O.J. No. 2124, 2011 CarswellOnt 2811) and the validity of certain proposals to be put to a vote (Economical Insurance Co. v. Andrus, 2011 ONSC 2184, 84 B.L.R. (4th) 289, 98 C.C.L.I. (4th) 98, 31 T.L.W.D. 3102-010, [2011] O.J. No. 1682, 2011 CarswellOnt 2298);

· Counsel to an emergency room physician at the jury trial of an action about the diagnosis of a rare complication which led to the patient's paralysis (S. v. H., 2010 ONSC 3440, 97 C.P.C. (6th) 353, [2010] O.J. No. 2522) and on the appeal of the trial decision (2011 ONCA 609, 107 O.R. (3d) 236, 88 C.C.L.T. (3d) 169, [2011] O.J. No. 4207, 2011 CarswellOnt 9821, 31 T.L.W.D. 3124-018);

· Counsel to a corporate defendant on a successful motion for security for costs in a commercial dispute where the plaintiff was found to have become a shell corporation (Corporate Business Services Inc. v. Herrad et al., [2009] O.J. No. 6095, 2010 CarswellOnt 9110) and the related appeal of that order (2010 ONSC 5754, [2010] O.J. No. 4610, 2010 CarswellOnt 8024).

In 2005-2006, Mr. Marques served as Law Clerk to the Rt. Hon. Chief Justice Beverley McLachlin of the Supreme Court of Canada.

Mr. Marques received his law degree with honours standing from the University of Toronto, Faculty of Law. He also holds a master's degree in public administration and public policy from the London School of Economics, awarded with Distinction, and an undergraduate honours degree in political science and history from the University of Ottawa, where he graduated summa cum laude. He was called to the Ontario bar in 2006.

Mr. Marques is a member of the Canadian Bar Association - Ontario, the Advocates' Society, the American Bar Association, the Medico-Legal Society of Toronto, the Toronto Lawyers Association, the Osgoode Society for Canadian Legal History, and the Portuguese Canadian Lawyers Association. He has previously served as a director of several not-for-profit organizations and currently serves on the board of directors of St. Christopher House, a United Way agency, and the London Goodenough Association of Canada.
