Elena Klonitskaya is an associate in the International Trade Practice Group with the Brussels office at Crowell & Moring LLP. Elena provides counseling to private companies and sovereign governments in the areas of international trade compliance, international trade negotiations, the World Trade Organization, international and EU customs regulations, EU sanctions and export controls, EU and Russian antitrust and competition laws, and EU and Russian regulatory regimes. She advises businesses in the energy, transport, chemical, steel, automotive, food & drink, electronics, textiles, footwear, IT, high-tech and services sectors.
As a practitioner of EU and international trade law, Elena advises clients on compliance with WTO provisions, market access issues involving the WTO agreements, and was involved in advising the Russian Government on Russian's accession to the WTO. She also advises clients on bilateral and multilateral agreements concluded by the EU, EU trade policy and its impact (regional and global) on businesses and their competitive positions.
Elena has extensive experience representing private companies in trade remedy cases in the EU and also outside of the EU. These include anti-dumping, anti-subsidy, safeguards, anti-circumvention proceedings and refunds. Since 2003, Elena has been representing companies from Russia, Ukraine, Belarus, Armenia, EU, US, China in trade remedy investigations in the EU, and has been assisting Russian companies in US and Chinese trade remedy matters.
Elena also provides guidance on matters of customs valuation and tariff classification, rules of origin, the Generalized System of Preferences, economic tariff regimes, duty suspensions and tariff quotas. She advises private companies on the EU and Russian customs laws.
Elena's export control work encompasses compliance with the EU laws governing embargoes, economic sanctions, anti-boycott laws, EU dual-use regime and national level controls in the EU. Elena has advised companies on transactional compliance, export licensing, voluntary disclosures, enforcement actions and corporate compliance programs.
Elena's experience in antitrust and competition law includes counseling private companies on matters related to mergers, joint ventures, cartels, and abuse of dominance. Elena has advised private companies on their horizontal and vertical arrangements, provided guidelines on competition compliance, advised on matters related to alleged abuse of dominance under EU and Russian laws, and advised companies in connection with multi-jurisdictional merger filings. In antitrust matters, Elena has experience counseling clients in gas, nuclear, steel, chemical and food & drink sectors. She has co-authored a number of articles on interpretation and implementation of antitrust rules in Russia.
Elena's EU regulatory experience includes work with the regulation of the EU energy markets, in particular on matters of liberalization, market access, security of energy supply, as well as EU environmental law, including the regulation of chemicals under REACH and CLP, technical regulations and standards, safety regulations, VAT, excise provisions, financial services, questions on EU institutional matters, etc. Elena also provides counseling on interpretation and implementation of Russian regulatory regimes.
Prior to joining Crowell Moring LLP in 2011, Elena was a senior associate for four years with the Brussels office at another international law firm, working with its international trade, antitrust and EU regulatory practice groups.
Prior to that, Elena spent nearly four years in the international trade practice of a UK-based law firm in Brussels.
She was also a stagiaire of Directorate General for Competition of the European Commission during the winter stage of 2002/2003, and from 2001 to 2002, she worked in the Moscow office of a Spanish law firm Roca Junyent Advocats.
Language Skills
In addition to her native Russian, Elena is fluent in English and Spanish, has a good command of German and French and also speaks some Italian.
